Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
criteria have been met.
The investigation was initiated in response to a petition
received on February 20, 2001, and filed on behalf of workers and
former workers at Sony Music Inc., Sony Disc Manufacturing,
Carrollton, Georgia. The workers were engaged in the production
of audio cassette shells, audio cassette jewel boxes and audio
cassette recording tape. The workers are separately identifiable
by product.
Sony Music Inc., Sony Disc Manufacturing, Carrollton,
Georgia, ceased production of audio cassette shells (CD's) and
audio cassette jewel boxes, impacting the plant workers. The
company began increasing their reliance on imported audio
cassette shells (CD's) and audio cassette jewel boxes during the
relevant period.
The company is in the process of ceasing all plant
production of audio cassette recording tape. Other investigation
findings show that the company has increased import purchases of
audio cassette recording tape from Mexico. The audio tape is
vertically integrated into the finished audio cassettes produced
by Sony.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increased imports of articles like
or directly competitive with audio cassette shells (CD's), audio
cassette jewel boxes, and audio cassette recording tape produced
at Sony Music Inc., Sony Disc Manufacturing, Carrollton, Georgia,
contributed importantly to the declines in sales or production
and to the total or partial separation of workers at the subject
firm. In accordance with the provisions of the Act, I make the
following certification:
"All workers of Sony Music Inc., Sony Disc Manufacturing,
Carrollton, Georgia, who became totally or partially
separated from employment on or after January 30, 2000,
through two years from date of certification, are eligible
to apply for adjustment assistance under Section 223 of the
Trade Act of 1974."
