Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on November 27, 2000 and filed on behalf of workers at
National Spinning Company, Inc., Washington, North Carolina (TA-
W-38,348); National Spinning Company, Inc., Warsaw, North Caroli-
na (TA-W-38,348A); National Spinning Company, Inc., Whiteville,
North Carolina (TA-W-38,348B); National Spinning Company, Inc.,
Beulaville, North Carolina (TA-W-38,348C); and, National Spinning
Company, Inc., New York, New York (TA-W-38,348D). The workers
produced primarily undyed and dyed acrylic yarn.
The investigation revealed that company-wide sales and
production decreased in 1999 compared to 1998 and in January-
October 2000 compared to the same period in 1999. Production at
all plants decreased in 1999 compared to 1998. Layoffs occurred
at all subject locations from August 2000 to December 2000.
U.S. imports of single yarns, other than sewing thread,
greater than or equal to 85 percent by weight of acrylic staple
fibers, not put up for retail sale increased in 1999 compared to
1998 and in January-October 2000 compared to the same period in
1999.
The investigation also revealed that the company lost
significant market share to imports in January-October 2000
compared to the same period in 1999.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with undyed and dyed acrylic yarn produced
at National Spinning Company, Inc., Washington, North Carolina;
National Spinning Company, Inc., Warsaw, North Carolina; National
Spinning Company, Inc., Whiteville, North Carolina; National
Spinning Company, Inc., Beulaville, North Carolina; and, National
Spinning Company, Inc., New York, New York contributed impor
tantly to the decline in sales or production and to the total or
partial separation of workers of that firm. In accordance with
the provisions of the Act, I make the following certification:
"All workers of National Spinning Company, Inc., Washington,
North Carolina; National Spinning Company, Inc., Warsaw,
North Carolina; National Spinning Company, Inc., Whiteville,
North Carolina; National Spinning Company, Inc., Beulaville,
North Carolina; and, National Spinning Company, Inc., New
York, New York engaged in employment related to the produc
tion of undyed and dyed acrylic yarn who became totally or
partially separated from employment on or after November 13,
1999 through two years from the date of certification are
eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974."
