Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Notice of
Certification Regarding Eligibility to Apply for Worker
Adjustment Assistance on November 28, 2000, applicable to workers
of Progress Lighting, Cowpens, South Carolina. The notice was
published in the Federal Register on December 21, 2000 (65 FR
80457).
At the request of the International Brotherhood of
Electrical Workers, Local 2005, the Department reviewed the
certification for workers of the subject firm. The company
reports that worker separations occurred at the Philadelphia,
Pennsylvania location of Progress Lighting. The Philadelphia,
Pennsylvania location is a distribution center for the lighting
fixtures produced in Cowpens, South Carolina.
Based on these findings, the Department is amending the
certification to include workers of the Philadelphia,
Pennsylvania location of Progress Lighting.
The intent of the Department=s certification is to include
all workers of Progress Lighting who were adversely affected by
increased imports.
The amended notice applicable to TA-W-38,307 is hereby
issued as follows:
"All workers of Progress Lighting, Cowpens, South Carolina
(TA-W-38,307) and Progress Lighting, Philadelphia,
Pennsylvania (TA-W-38,307A) who became totally or partially
separated from employment on or after October 28, 1999
through November 28, 2002, are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974.@

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined that all of the requirements
have been met.
The investigation was initiated in response to a petition
received on November 13, 2000, filed on behalf of workers at
Progress Lighting, Cowpens, South Carolina. The workers were
engaged in the production of lighting fixtures.
Workers at the subject firm were certified eligible to apply
for NAFTA-Transitional Adjustment Assistance on October 31, 2000
(NAFTA-4208).


Investigation findings revealed that production and
employment at the Cowpens, South Carolina facility has declined
during the relevant period. The company has increased it=s
imports of lighting fixtures.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with light fixtures manufactured at Progress
Lighting, Cowpens, South Carolina, contributed importantly to the
total or partial separation of workers of that firm. In
accordance with the provisions of the Act, I make the following
certification:
"All workers of Progress Lighting, Cowpens, South Carolina,
who became totally or partially separated from employment on
or after October 28, 1999, through two years from the date
of certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974."
