Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on November 13, 2000, and filed on behalf of workers at
Stora Enso Consolidated Papers, Inc., d.b.a. Stora Enso North
America, Administrative Offices, Wisconsin Rapids, Wisconsin (TA-W-
38,305) including the following locations: Biron Mill Division,
formerly known as Biron Division, Wisconsin Rapids, Wisconsin (TA-
W-38,305A); Kimberly Mill, formerly known as Inter Lake Papers
Division, Kimberly, Wisconsin (TA-W-38,305B); Wisconsin Rapids Pulp
Mill, formerly known as Kraft Division, Wisconsin Rapids, Wisconsin
(TA-W-38,305C); Duluth Paper Mill & Duluth Recycled Pulp Mill,
formerly known as Lake Superior Paper Industries, Duluth, Minnesota
(TA-W-38,305D); Niagara Mill, formerly known as Niagara Division,
Niagara, Wisconsin (TA-W-38,305E); Wisconsin Rapids Paperboard,
formerly known as Paperboard Products Division, Wisconsin Rapids,
Wisconsin Rapids, Wisconsin, (TA-W-38,305F); Research, formerly
known as Research and Development, Wisconsin Rapids, Wisconsin (TA-
W-38,305G); Stevens Point Mill, formerly known as Stevens Point
Division, Stevens Point, Wisconsin (TA-W-38,305H); Wisconsin Rapids
Paper Mill, formerly known as Wisconsin Rapids Division and
Converting Division, Wisconsin Rapids, Wisconsin (TA-W-38,305I) and
Whiting Mill, formerly known as Wisconsin River Division, Stevens
Point (TA-W-38,305J). Workers were engaged in the various stages
(including support activities) in the production of paper and pulp
(uncoated groundwood, uncoated free sheet, coated groundwood).
The investigation revealed that sales, production, and
employment decreased during the relevant period.
The company increased their imports of pulp and paper during
the relevant period.
The investigation further revealed that the company is a major
U.S. producer of the paper products indicated above. Aggregate
U.S. imports of paper like and directly competitive with those
products produced by the subject company increased significantly
during the relevant period.
In regard to workers of Niagara Mill, formerly known as
Niagara Division, Niagara, Wisconsin (TA-W-38,305E) were certified
under a Notice of Determination on Reconsideration for Trade
Adjustment Assistance on October 28, 1999. The workers are under
an existing certification through October 28, 2001. The
identifying number is TA-W-36,240.
Currently, there is a NAFTA-Transitional Adjustment Assistance
investigation for the workers of the subject plant. The
identifying number is NAFTA - 04276.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with paper contributed importantly to the
decline in sales or production and to the total or partial
separation of workers of the subject firm. In accordance with the
provisions of the Act, I make the following certification:
"All workers of Stora Enso Consolidated Papers, Inc., d.b.a.
Stora Enso North America, Administrative Offices, Wisconsin
Rapids, Wisconsin (TA-W-38,305) including the following
locations: Biron Mill Division, formerly known as Biron
Division, Wisconsin Rapids, Wisconsin (TA-W-38,305A); Kimberly
Mill, formerly known as Inter Lake Papers Division, Kimberly,
Wisconsin (TA-W-38,305B); Wisconsin Rapids Pulp Mill, formerly
known as Kraft Division, Wisconsin Rapids, Wisconsin (TA-W-
38,305C); Duluth Paper Mill & Duluth Recycled Pulp Mill,
formerly known as Lake Superior Paper Industries, Duluth,
Minnesota (TA-W-38,305D); Wisconsin Rapids Paperboard,
formerly known as Paperboard Products Division, Wisconsin
Rapids, Wisconsin Rapids, Wisconsin, (TA-W-38,305F); Research,
formerly known as Research and Development, Wisconsin Rapids,
Wisconsin (TA-W-38,305G); Stevens Point Mill, formerly known
as Stevens Point Division, Stevens Point, Wisconsin (TA-W-
38,305H); Wisconsin Rapids Paper Mill, formerly known as
Wisconsin Rapids Division and Converting Division, Wisconsin
Rapids, Wisconsin (TA-W-38,305I) and Whiting Mill, formerly
known as Wisconsin River Division, Stevens Point (TA-W-
38,305J) who became totally or partially separated from
employment on or after October 31, 1999 through two years from
the date of certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974;" and
"I further determined that workers of the Niagara Division,
Niagara, Wisconsin (TA-W-38,305E) are denied eligibility to
apply for adjustment assistance under Section 223 of the Trade
Act of 1974 because the workers are eligible under TA-W-
36,240, which does not expire until October 28, 2001."
