Certification Regarding Eligibility
to Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on September 25, 2000, and filed on behalf of workers at
Eastland Shoe Manufacturing Corporation, Freeport and Lisbon
Falls, Maine. The workers produced men's and women's shoes,
boots and sandals.
Workers at the Eastland Shoe Manufacturing Corporation in
Freeport and Lisbon Falls, Maine, were previously certified
eligible to apply for worker adjustment assistance under petition
numbers TA-W-35,092 and TA-W-35,092A, respectively. These
certifications expired November 16, 2000.
The investigation revealed that production and employment at
the subject firm locations in Lisbon Falls and Freeport, Maine
declined during the relevant time period. Production has ceased
at the Lisbon Falls plant. Although the Lisbon Falls plant
closed November 11, 2000, and the workers would be eligible to
apply for worker adjustment assistance under TA-W-35,092A, some
workers remain at the plant to facilitate the closing. The
subject firm reports that employment continues to decline at the
Freeport facility.
Company imports of footwear increased significantly in
January through August 2000 compared to the same time period of
the previous year.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with those produced by Eastland Shoe
Manufacturing Company, Lisbon Falls and Freeport, Maine,
contributed importantly to the decline in sales and production
and to the total or partial separation of workers of the subject
firm. In accordance with the provisions of the Act, I make the
following certification:
"All workers at Eastland Shoe Manufacturing Company,
Lisbon Falls, Maine and Freeport, Maine, who became
totally or partially separated from employment on or
after November 17, 2000, through two years from the
date of certification, are eligible to apply for
adjustment assistance under Section 223 of the Trade
Act of 1974."
