Gentlemen:

This office has recently completed an audit of under the Compliance Audit Program (CAP) to determine your organization’s compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). As discussed during the exit interview with on March 31, 2009, no violations of the LMRDA were disclosed in areas of financial activity included in the CAP. This does not exhaust all possible problem areas, however, since the audit conducted was limited in scope and did not include all areas of your union’s operation.

United Auto Workers (UAW) Region 9 has been actively organizing casino workers in Atlantic City, New Jersey. To pay for these efforts, the UAW quarterly sends Local 595 money to pay for these activities. The money is commingled with the local union’s operating account. Officers of the Local 595 lack discretionary control over the spending of these sums. Organizers’ vouchers are submitted to Region 9 and approved at that level. The officers of Local 595 disburse specific amounts to designated payees, as instructed by Region 9. As we discussed at our last meeting, it is strongly suggested that you establish a separate bank account to be used for the organizing activities. Separate books of original entry – as well as full documentation – should be maintained as well.
