While the vast majority of union officers and employees do their work diligently and without incident, unfortunately civil violations do sometimes occur and, when they do, the union is the victim. The Office of Labor-Management Standards (OLMS) conducts civil investigations of alleged violations of the Labor-Management Reporting and Disclosure Act (LMRDA) and related laws. These investigations by OLMS District Offices involve issues such as union officer elections, the filing of required reports by unions, employers, and labor relations consultants with OLMS, and the imposition of trusteeships over subordinate unions by a parent body. These investigations may result in Civil Enforcement Actions or, in election cases, Voluntary Compliance Agreements reached without resort to litigation.

Voluntary Compliance Agreements

When an OLMS investigation determines that a violation of Title IV of the LMRDA has occurred and that the violation may have affected the outcome of a union officer election, OLMS seeks to enter into an agreement with the union for voluntary corrective action. Under these voluntary compliance agreements, a new election is held under OLMS supervision, avoiding any litigation. Most election complaints are resolved through these Voluntary Compliance Agreements. Entry into a Voluntary Compliance Agreement is not an admission by the union that a violation occurred nor does it reflect a judicial finding of a violation.
