Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on April
23, 2003, applicable to workers of American Quality Ceramics,
Bangs, Texas. The notice was published in the Federal Register
on May 7, 2003 (68 FR 24504).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
were engaged in the production of collectible plates and mugs.
New information shows that Tempo Lighting, Inc. is the
parent firm of American Quality Ceramics. Information also shows
that workers separated from employment at the subject firm had
their wages reported under a separate unemployment insurance (UI)
tax account for Tempo Lighting, Inc.
Accordingly, the Department is amending the certification to
properly reflect this matter.
The intent of the Department’s certification is to include
all workers of American Quality Ceramics, Bangs who were
adversely affected by increased imports.
The amended notice applicable to TA-W-51,378 is hereby
issued as follows:
"All workers of American Quality Ceramics, Tempo
Lighting, Inc., Bangs, Texas, who became totally or
partially separated from employment on or after March
31, 2002, through April 23, 2005, are eligible to apply
for adjustment assistance under Section 223 of the
Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on April 1, 2003, in response
to a petition filed by a company official on behalf of workers of
American Quality Ceramics, Bangs, Texas. The workers at the
subject firm produced collectible plates and mugs.
The investigation revealed that sales, production and
employment at the subject firm decreased during the period of
January through March of 2003 when compared to the same period in
2002.
The Department of Labor surveyed the subject firm’s major
customers regarding their purchases of collectible plates and mugs
during 2001, 2002 and January through March 2003 over the
corresponding 2002 period. The survey revealed that customers
increased their reliance on imported collectible plates and mugs
during the period under investigation.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with collectible plates and mugs
produced at American Quality Ceramics, Bangs, Texas contributed
importantly to the total or partial separation of workers and to
the decline in sales or production and at that firm or subdivision.
In accordance with the provisions of the Act, I make the
following certification:
"All workers of American Quality Ceramics, Bangs, Texas who
became totally or partially separated from employment on or
after March 31, 2002 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974."
