Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Notice of
Certification Regarding Eligibility to Apply for Worker
Adjustment Assistance on January 2, 2002, applicable to workers
of Minster Machine Company, Minster, Ohio. The notice was
published in the Federal Register on January 11, 2002 (67 FR
1511).
At the request of the company, the Department reviewed the
certification for workers of the subject firm. The company
reports that worker separations occurred at the Beaufort
Operation, Beaufort, South Carolina location of Minster Machine
Company. The Beaufort Operation produces material handling
equipment required for the operation of punch presses produced at
the Minster, Ohio location of the subject firm.
Based on these findings, the Department is amending the
certification to include workers of the Beaufort Operation,
Beaufort, South Carolina location of Minster Machine Company.
The intent of the Department=s certification is to include
all workers of Minster Machine Company who were adversely
affected by increased imports.
The amended notice applicable to TA-W-39,931 is hereby
issued as follows:
"All workers of Minster Machine Company, Minster, Ohio
(TA-W-39,931) and Minster Machine Company, Beaufort
Operation, Beaufort, South Carolina (TA-W-39,931A) who
became totally or partially separated from employment on or
after August 16, 2000, through January 2, 2004, are eligible
to apply for adjustment assistance under Section 223 of the
Trade Act of 1974.@

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated on September 4, 2001, in response to a petition filed by the
United Steelworkers of America, Local 3210, on behalf of workers at Minster Machine Company,
Minster, Ohio. The workers are engaged in employment related to the production of material
forming punch presses. The investigation revealed that production and employment at the
subject plant decreased during the relevant period.
The Department of Labor surveyed major customers of the
subject firm regarding their purchases of material forming punch presses in 1999-2000 and January
to September, 2000-2001.
Respondents indicated that they increased imports in one or more sets of time periods.
Conclusion
After careful review of the facts obtained in the investi-gation, I conclude that increases of
imports of articles like or directly competitive with those produced by Minster Machine Company,
Minster, Ohio, contributed importantly to the decline in sales or production and to the total or partial
separation of workers of that firm. In accordance with the provisions of the Trade Act, I make the
following certification:
"All workers at Minster Machine Company, Minster, Ohio, who became totally or partially
separated from employment on or after August 16, 2000, through two years from the date of
certification, are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974."
