Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on Augst 6, 2001, filed by the company on behalf of the
workers at Russell Corporation, Jerzees Activewear, LaFayette,
Alabama (TA-W-39,773); Russell Corporation, Russell Yarn-Coosa,
Alexander City, Alabama (TA-W-39,773A); Russell Corporation,
Jerzees Activewear, Sylacauga, Alabama (TA-W-39,773B) and Russell
Corporation, Russell Athletic (Hi-Tech Plant), Alexander City,
Alabama (TA-W-39,773C) were engaged in the production of t-shirts
and sweatshirts. The workers at Russell Corporation, Russell
Yarn-Coosa, Alexander City, Alabama produced yarn and the workers
at Russell Corporation, Jerzees Activewear, Sylacauga, Alabama
produced fabric for t-shirts. The yarn and fabric are vertically
integrated into the production of t-shirts at the subject plant
facilities. The workers are not separately identifiable by
product line within each plant.
The subject plants recently ceased production.
The preponderance in the declines in employment at the
subject plant is attributed to the company shifting a significant
portion of plant production of t-shirts and sweatshirts to
foreign sources and the simultaneous increase in imports of
t-shirts and sweatshirts back to the United States.
The workers of Russell Corporation, Jerzees Activewear,
Sylacauga, Alabama (TA-W-39,773B), were under an existing Trade
Adjustment Assistance certification (TA-W-36,110) which expired
on June 8, 2001.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with t-shirts and sweatshirts
produced by Russell Corporation, Jerzees Activewear, LaFayette,
Alabama (TA-W-39,773); Russell Corporation, Russell Yarn-Coosa,
Alexander City, Alabama (TA-W-39,773A); Russell Corporation,
Jerzees Activewear, Sylacauga, Alabama (TA-W-39,773B) and Russell
Corporation, Russell Athletic (Hi-Tech Plant), Alexander City,
Alabama (TA-W-39,773C), contributed importantly to the decline in
sales, production and to the total or partial separation of
workers of that firm. In accordance with the provisions of the
Act, I make the following certification:
"All workers of Russell Corporation, Jerzees Activewear,
LaFayette, Alabama (TA-W-39,773); Russell Corporation,
Russell Yarn-Coosa, Alexander City, Alabama (TA-W-39,773A);
and Russell Corporation, Russell Athletic (Hi-Tech Plant),
Alexander City, Alabama (TA-W-39,773C), who became totally
or partially separated from employment on or after July 9,
2000, through two years from the date of certification are
eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974;" and
"All workers of Russell Corporation, Jerzees Activewear,
Sylacauga, Alabama (TA-W-39,773B), who became totally or
partially separated from employment on or after June 9,
2001, through two years from the date of certification are
eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974."
