Dismissing a Complaint
Concerning the Trusteeship Imposed by the
International Association of Machinists on its affiliate,
National Federation of Federal Employees Local 1705
This Statement of Reasons dismisses the December 7, 2012 complaint filed with the United States Department of Labor alleging that violations of Title III of the Labor Management Reporting and Disclosure Act of 1959 (LMRDA), 29 U.S.C. §§ 461-466, as made applicable to federal sector unions by 29 C.F.R. § 458.26 – 28 and the Civil Service Reform Act of 1978 (CSRA), 5 U.S.C. § 7120(d), occurred with respect to a trusteeship imposed by the International Association of Machinists upon Machinists District 1, National Federation of Federal Employees, Local 1705 (Local 1705). The complaint is dismissed for the following reason.
On April 22, 2013, the International Association of Machinists filed a terminal LM-4 report with the Department, showing that it had terminated Local 1705 on July 31, 2012. Local 1705 was terminated after being merged with Locals 1800 and 1642. Since Local 1705 no longer exists, the allegations are moot. The investigation failed to disclose any violation of the Act upon which the Secretary of Labor may bring an action under section 304 of the Act, 29 U.S.C. § 464. Accordingly, the office has closed the file in this matter.

This is to advise you of the disposition of your complaint filed with the Office of Labor Management Standards (OLMS) alleging that violations of Title III of the Labor-Management Reporting and Disclosure Act of 1959, 29 U.S.C. §§ 461-466, as made applicable to elections of federal sector unions by 29 C.F.R. § 458.26 and the Civil Service Reform Act of 1978, 5 U.S.C. § 7120(d) and 29 C.F.R. § 458.26, occurred with respect to a trusteeship imposed by the International Association of Machinists over its affiliated Local 1705, National Federation of Federal Employees, in Washington, DC.
An investigation was conducted by OLMS. After carefully reviewing the investigative findings, we have determined that legal action is not warranted in this case. Therefore, we are closing our file as of this date. The basis for this decision is set forth in the enclosed Statement of Reasons.
