DETERMINATION

Determination of a Complaint Filed under Filed under Title IV
of the Labor-Management Reporting and Disclosure Act of 1959



On February 20, 2013, the Secretary of Labor received a complaint alleging a violation of Section 401 of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA), in that Fraternal Order of Police Amtrak Police Labor Committee Lodge 189 in New York, New York failed to hold its regularly scheduled election of officers in October 2012.

Pursuant to Sections 402 and 601 of the LMRDA, the Department of Labor conducted an investigation. The investigation disclosed that the lodge failed to hold an election.

Apprised of these findings, Fraternal Order of Police Amtrak Police Labor Committee Lodge 189 agreed to conduct an election of officers under the supervision of the Chief of the Division of Enforcement, OLMS, in accordance with Title IV of the LMRDA. The agreed upon remedial election was concluded on July 25, 2013. It is, therefore,

DETERMINED, that there is probable cause to believe that a violation of Title IV of the LMRDA occurred when Fraternal Order of Police Amtrak Police Labor Committee Lodge 189 failed to hold its regularly scheduled election of officers in October 2012, but that this violation has been remedied by the election, conducted in accordance with Title IV of the LMRDA, under the supervision of the Chief, Division of Enforcement, OLMS, on July 25, 2013.

Therefore, enforcement proceedings under Section 402(b) of the LMRDA are not warranted.
