Determination of a Complaint Filed under Title IV of the Labor-Management Reporting and Disclosure Act of 1959

On November 7, 2011, the Secretary of Labor received a complaint alleging a violation of Section 401 of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA), when Service Employee International Union Local 601 in Ponce, Puerto Rico, failed to conduct its regularly scheduled election of officers.

Pursuant to Sections 402 and 601 of the LMRDA, the Department of Labor conducted an investigation. The investigation disclosed that Local 601 failed to hold the regularly scheduled nominations and election of officers in June 2011.

Apprised of these findings, Local 601 agreed to conduct nominations and election under the supervision of the Secretary of Labor, in accordance with Title IV of the LMRDA. The agreed upon remedial election was concluded on March 24, 2012. It is, therefore,

DETERMINED, that there is probable cause to believe that a violation of Title IV of the LMRDA occurred by Service Employee International Union Local 601 in June 2011, but that the violation has been remedied by the new election, conducted in accordance with Title IV of the LMRDA, under the supervision of the Secretary of Labor, on March 24, 2012.

Therefore, civil action under Section 402(b) of the LMRDA is not warranted.
