This proceeding arose under the standards of conduct provisions of the Civil Service ReformAct of 1978, 5 U.S.C. 7 120, and the implemeatiug replatbns, 29 CPR Parts 457459, a8 a result of a complaint filed aganist Local 397 of the National Federation of Federal Employees (NFEE) concerning the failure of the local to file the labor orgainzation annual financial reports required by the CSRA, 5 U.S.C. 7120(d), and the implementing regulations, 29 CFR 458.3, for the fiscal by the CSRA, 5 U.S.C 7120(d), and implementing regluations, 29 CFR 458.3, for the fiscal years ending June 30, 1991, 1992, 1993, 1994, and 1995. The respondent did not file an answer to the complaint. On March 29, 1996, Administrative Law Judge Donald W. Mosser issuded his Recommended Decision and Order recommending that the respondent be directed and compelled to file the required annual financial reports. 2 No exceptions were filed to the Recommended.

Pursuant to 29 CFR 458.66, the Regional Director is the complainany in a case alleging violations of the reporting requirements in 29 CFR 458.3.

The text of the Recommended Decision and Order refers to the respondent as "Government Employees, Local 397" and "Local 397, Government Employees, AFGE;" however, "Local 397, Federal Employees, NFFE" is correctly listed as the respondent in the heading of the Recommended Decision and Order and it was served on the president of Local 397, NFFE.

ORDER

IT IS HEREBY ORDERED, THAT, the respondent labor organization file annual financial reports on the appropriate LM forms for its fiscal years ending June 30, 1991, 1992, 1993,1994,
and 1995.
