On May 1, 2026, in the United States District Court for the District of Utah, the Department filed suit against SkyWest InFlight Association (SIA), located in Salt Lake City, Utah, concerning its January 2026 election of two representative board members. The OLMS investigation determined that SIA denied a member in good standing the right to be a candidate when it unreasonably applied a candidacy requirement. The investigation found the requirement was unreasonably applied because it was applied retroactively and because it was not applied in a uniform manner. Additionally, SIA improperly denied this member in good standing for lack of continuous good standing based on discipline imposed without first affording the member the full due process rights required under Title I of the LMRDA. The lawsuit follows an investigation by the OLMS Denver-St. Louis District Office.
