Dear Mr. Baker:

This is in response to your continuing hardship exemption request for the ILWU LU 200 Unit 223, LM File Number 519-325, for the fiscal year ending December 31, 2008.  Your undated request was received by the Office of Labor-Management Standards (OLMS) on December 1, 2009.  A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.

In your letter, you stated that you purchased the electronic signatures and made attempts to comply with the requirement to file your Form LM-2 electronically.  However, you were informed by the OLMS LM software support team that your computer and the submitted report were apparently corrupted by an unknown virus and consequently the submitted report was unacceptable.  Given your location, you do not have access to another computer to attempt a further electronic filing.

OLMS grants your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending December 31, 2008, based on the information provided.  I note that you filed a paper copy of your Form LM-2 with OLMS on September 14, 2009.
