Form LM-10 Employer Report
The Office of Labor-Management Standards (OLMS) will publish, on September 13, 2022, a proposed revision to the Form LM-10 Employer Report. See: https://public-inspection.federalregister.gov/2022-19229.pdf. Pursuant to the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA), employers must file a Form LM-10 with OLMS to disclose certain payments, expenditures, agreements, and arrangements. Employers must file reports covering, among other areas, agreements with consultants (and other payments and expenditures) made with an object to persuade employees concerning their organizing and collective bargaining rights or to surveil the activities of employees and unions involved in a labor dispute with such employers. OLMS proposes to add to the Form LM-10 report a checkbox requiring such employers to indicate whether they were Federal contractors or subcontractors, and two lines for entry of filers’ Unique Entity Identifier and Federal contracting agency or agencies. The proposed revision explains that the transparency created by these revisions would better inform workers in making determinations regarding the exercise of their rights to organize and bargain collectively.
