Advisory Regarding Filing of Forms LM-10 and LM-30

The Department of Labor's Office of Labor-Management Standards has engaged in initiatives in 2005 and 2006 to educate employers and labor organization officers and employees about the circumstances under which they are required to file Form LM-10 and Form LM-30, respectively. These reports are due within 90 days after the end of the filer's fiscal year. Many filers have a fiscal year ending date of December 31, which means that their 2005 report is due by March 31, 2006. OLMS posted a Form LM-10 advisory on its Web site on November 10, 2005. The Department subsequently received numerous inquiries relating to the reporting requirements, particularly concerning Form LM-10. On March 7, 2006, OLMS posted on its Web site extensive additional Frequently Asked Questions about Form LM-10, some of which also relate to Form LM-30. These FAQs are posted on the OLMS Web site.

Due to the short time remaining before the deadline for filing Forms LM-10 and LM-30 for the fiscal year that ended December 31, 2005, OLMS, pursuant to its enforcement discretion, issues this advisory. Although the Department of Labor has no authority to grant extensions of the statutory filing deadlines, for those employers and labor organization officers and employees whose report is due by March 31, 2006, the Department of Labor will not take any enforcement action until May 15, 2006, to compel the filing of delinquent Forms LM-10 and LM-30. A Form LM-10 filed on or before May 15, 2006 will be considered -on time- for the purposes of the Form LM-10 grace-period provisions discussed in FAQs 66 and 70.
