To provide guidance to states regarding UC flexibilities related to COVID-19, specifically in determining eligibility of an individual whose employment is subject to the "between and within terms" denial provisions of Section 3304(a)(6)(A), FUTA.

The purpose of this Unemployment Insurance Program Letter (UIPL) is to provide guidance to State Workforce Agencies on changes in the operation of the BAM program, including BAM sample selection and case management applications, as a result of issues arising from the COVID-19 pandemic. These COVID-19-related issues include the unprecedented increases in Unemployment Insurance (UI) program workloads and the new Unemployment Compensation (UC) programs created in the Coronavirus Aid, Relief, and Economic Security (CARES) Act (Public Law 116-136), including the Federal Pandemic Unemployment Compensation (FPUC) program, which provides a federal payment of $600 in addition to the state Weekly Benefit Amount (WBA).

To inform states of the new methodology used to calculate the "on" or "off" total unemployment rate (TUR) indicators to determine when extended benefit (EB) periods begin and end in a state.

The purpose of this Unemployment Insurance Program Letter (UIPL) is to provide states with the new ETA 227-Overpayment Detection and Recovery Activities FPUC report (referred to as the "ETA 227 FPUC report" in this UIPL) and to provide states with revised reporting instructions for the FPUC program. Section 2104 of the CARES Act, Public Law (Pub. L.) 116-136, authorizes the FPUC program.

To transmit the subject computation for State Workforce Agency usage in computing minimum weekly DUA amounts for all major disasters declared from July 1 - September 30, 2020, (fourth quarter of Fiscal Year (FY) 2020).

To inform states of updates to the procedures to implement a program to recover unemployment compensation (UC) debt under the “Treasury Offset Program” (TOP) and to provide responses to frequently asked questions about the implementation process.

To announce the availability of ETA 9177 Report - Pre-Implementation Planning Checklist Report Version 1, revising the original version provided with Unemployment Insurance Program Letter (UIPL) No. 11-18, to assist state UI agencies in preparing to launch modernized UI IT systems that support administration of UI benefits and/or tax systems.

As states have gained experience administering the PUA program under the CARES Act, Public Law (Pub. L. 116-136), they have identified additional questions about program operations. The purpose of this Unemployment Insurance Program Letter (UIPL) is to address those questions concerning the PUA program.

L.) 116-151 which amends Section 903(i) of the Social Security Act (SSA) (42 U.S.C. § 1103(i)). Section 903(i), SSA, was created by Section 2103 of the CARES Act (Pub. L. 116-136).
