Guidance on Services provided through the Adult and Dislocated Worker Programs under the Workforce Innovation and Opportunity Act (WIOA) and the Wagner-Peyser Act Employment Service (ES), as amended by title III of WIOA, and for Implementation of the WIOA Final Rules

Purpose

To provide guidance to the workforce system on delivering services under the Adult and Dislocated Worker programs under WIOA Title I, and individuals served by the ES program, as amended by WIOA Title III, under the WIOA Final Rule.

WIOA, signed into law on July 22, 2014, supersedes titles I and II of the Workforce Investment Act of 1998 (WIA) and amends the Wagner-Peyser Act of 1933 and the Rehabilitation Act of 1973. In general, WIOA took effect on July 1, 2015, the first full program year after enactment, unless otherwise noted. On August 19, 2016, the Departments of Labor (DOL) and Education published the WIOA Final Rules in the Federal Register. The DOL-only rule became fully effective on October 18, 2016, 60 days after it was published on the Federal Register.

In order to continue implementation of WIOA prior to publication of the final rule, DOL issued a Training and Employment Guidance Letter (TEGL) 3-15, on July 1, 2015, which provided guidance to the public workforce system on delivering services to adults and dislocated workers under WIOA. This TEGL rescinds TEGL 3-15, and provides updated guidance to the public workforce system on service delivery to adults and dislocated workers, consistent with WIOA and the WIOA Final Rules. The section of the final rule pertaining to services for adults and dislocated workers under WIOA title I can be found at 20 CFR part 680 The sections of the final rule pertaining to individuals served under the Wagner-Peyser Act programs, as revised, can be found at 20 CFR parts 651, 652, 653 and 658.

Third Workforce Innovation and Opportunity Act (WIOA) Title I Youth Formula Program Guidance

Purpose

To provide guidance and planning information to states, local workforce areas, and other recipients of WIOA Title I youth formula funds on the activities associated with the implementation of WIOA.

WIOA became law on July 22, 2014 and supersedes Titles I and II of the Workforce Investment Act of 1998 (WIA), and amends the Wagner-Peyser Act and the Rehabilitation Act of 1973. The Departments of Labor and Education published a set of regulations for implementing WIOA. These WIOA Final Rules were made public on July 1, 2016, and the rules covering the Title I youth formula program became effective on October 18, 2016.

Revised Fiscal Year (FY) 2017 Advance Funding Levels Available October 2016 for Workforce Innovation and Opportunity Act (WIOA) Programs

Purpose

This guidance provides states with revised allotment levels for WIOA Adult and Dislocated Worker FY 2017 funds, which became available to states in October 2016. Change 1 to TEGL 17-15 indicated a 0.496 percent reduction to funding available to states on October 2016. Change 2 amends this to a 0.1901 percent reduction as enacted in the short-term Further Continuing Appropriations Act for FY 2017, providing all fifty seven state and outlying area grantees with additional funding.

References: (a) Job Training Partnership Act (JTPA) final regulations at 20 CFR Section 627.455 and 627.904; (b) TEGL No. 4-97, "Calendar Year 1998 Summer Youth Employment and Training Program"; and (c) TEGL No. 7-95, "JTPA Intertitle Transfer of Funds". Background: The JQSR for the Title II program under the JTPA, as amended, displays cumulative data on fund availability and accrued expenditures for Title II formula funded programs. OMB Approval and Reporting Burden: The JQSR data collection instrument and instructions have been approved by OMB according to the Paperwork Reduction Act of 1980, as amended. The JQSR report has been approved under OMB Approval No. 1205-0323, with an expiration date of 07/31/2000. Reporting Requirements: A separate JQSR must be submitted for each Program Year (PY) of funds for Titles II-A/II-C and each Fiscal Year (FY) of Title II-B funds, cumulative for the life of the funds. The JQSR is due in the Regional Offices no later than 45 days after the end of each PY quarter. A final JQSR is due once all funds allotted in a program year or fiscal year (II-B) have been expended but no later than 90 days after the expiration of the period of fund availability for a program/fiscal year s funds. The quarterly due dates are 11/15, 2/15, 5/15 and 8/15. Following are revisions which were made to the JQSR: (1) Line 5, Total Expenditures, was changed to add "SUM OF LINES 6, 7, 8, 9, 13, AND 20"; and (2) Section VII, TITLE II-A/TITLE III TRANSFERS, was added to report intertitle transfers on LINE 37. In preparing this report, transfers for Titles II and III should be reported in accordance with the instructions provided in TEGL 7-95 on JTPA Intertitle Transfers. In addition, all fiscal year transfers for Title II-B and program year transfers for Title III must be reflected in the overall total for Line 2, Column D, and Line 18, Column D of the JQSR. The approved instructions for completion of the JQSR are attached. In compliance with the Paperwork Reduction Act of 1980, ETA continues to encourage States to transmit the JQSR data electronically. States may continue to submit this data on floppy disk or by electronic mail using the ASCII data format in Attachment II. Starting in the first quarter of PY 1998, States will be provided with the option to submit reports via the Internet in a Year 2000 compliant format. New reporting procedures will be forwarded once they are finalized. Action Required: State JTPA Liaisons are requested to distribute the attached JQSR instructions to all officials within the State who need such information to implement the JQSR reporting requirements.
