Purpose

This guidance provides states with revised allotment levels for WIOA Adult and Dislocated Worker FY 2017 funds, which became available to states in October 2016. This Change 1 to TEGL 17-15 revises the funding available to states on October 2016 to reflect the 0.496 percent reduction enacted in the short-term Continuing Appropriations Act for FY 2017 that was enacted on September 29, 2016 and corrects the Adults age range for the economically disadvantaged data factor.

Performance Accountability Guidance for Workforce Innovation and Opportunity Act (WIOA) Title I, Title II, Title III and Title IV Core Programs

Purpose

This Training and Employment Guidance Letter (TEGL) provides sub-regulatory guidance on the requirements set forth in the Workforce Innovation and Opportunity Act (WIOA), related to the implementation and operation of the performance accountability system under section 116 of WIOA and the implementing joint regulations in 20 CFR part 677 (and reprinted in 34 CFR parts 361 and 463). As explained further in this guidance, developed jointly by the U.S. Departments of Labor (DOL) and Education (ED)(Departments), WIOA requires all States and direct grantees of the Departments to collect and report information on all the participants described in this TEGL.

WIOA, signed into law on July 22, 2014, is designed to help job seekers access employment, education, training, and support services to succeed in the labor market and to match employers with the skilled workers they need to compete in the global economy. WIOA supersedes titles I and II of the Workforce Investment Act of 1998 (WIA) and amends the Wagner-Peyser Act and the Rehabilitation Act of 1973.

The WIOA Joint Rule for Unified and Combined State Plans, Performance Accountability, and the One-Stop System Joint Provisions (Joint WIOA Final Rule) was published in the Federal Register on August 19, 2016, at 81 FR 55791, and took effect on October 18, 2016. This guidance is based on the statutory requirements of WIOA, as well as its implementing final regulations.

Welfare-to-Work Grants Interim Final Rule, 20 CFR 645 (62 Fed. Reg. 61588 (Nov. 18, 1997)). Background: Transportation is one of the main challenges facing people making the transition from welfare to work. A mismatch exists between the location of available entry level and service sector jobs and the residences of most welfare recipients. Two-thirds of new jobs are in the suburbs, but three of four welfare recipients live in rural areas or central cities, with few recipients owning cars. Many entry level jobs require evening or weekend hours in areas that are poorly served by existing transit routes or are not within a reasonable commute time. Many parents going to work also need transportation in order to access child care, which further complicates getting to and from work. The transportation barrier is magnified for low-income Americans living in rural counties, 40 percent of which have no public transportation services. Historically, HHS and DOL have defined transportation in terms of the individual client. As a result, funds were used to directly reimburse clients for transportation rather than to develop and support transportation services necessary to meet their needs. Welfare reform calls for a more systemic approach to break down the transportation barriers. For example, supporting and developing services such as connector services to mass transit, vanpools, sharing buses with elderly and youth programs, coordinating with existing human services transportation resources, employer provided transportation, or guaranteed ride home programs may be necessary to address the transportation problems for welfare recipients and other low income persons.
