Background: Due to changes in personnel, facilities and agency reorganizations, periodic updates of State agency contacts are necessary. States have provided the names and telephone numbers of individuals designated to respond to inquiries from other States about UC tax and employer accounts. This directory reflects information provided through June 1993. It replaces the directory attached to UIPL No. 35-92. Changes: When changes occur, the page to be changed should be copied and the changes penned in. Mail or fax the revised page to the appropriate Regional Office. They will update their information and forward the changes to the Unemployment Insurance Service (UIS) National Office for inclusion in the next directory update. Action Required: All SESAs are requested to ensure that a copy of the attached directory is made available to appropriate personnel.

References: The National Defense Authorization Act for Fiscal Year (FY) 1994, P.L. 103-160, section 1339 and The National Defense Authorization Act for FY 1995, P.L. 103-337, sections 1136 and 1137. Background: The National Defense Authorization Act for FY 1994 was enacted on November 30, 1993. The National Defense Authorization Act for FY 1995 was enacted on October 5, 1994. Included were amendments to Sections 325 and 325A of Title III of JTPA. Discussion: The amendments to Sections 325 (DCA) and 325A (DDP) essentially focused on three areas: a. Both DCA and DDP may be funded with "funds made available to carry out this section." That means that National Reserve Account funds under Part B of Title III may be awarded and administered in accordance with section 325 and 325A. b. DDP provisions were amended to clarify that the Secretary of Labor is responsible for Federal implementation of Section 325A. c. Eligible workers under both DCA and DDP include workers dislocated as a result of reduction in the export of defense articles and Defense services as a result of United States policy. Both DCA and DDP are administered by eligible grantees with funds awarded by the Secretary according to application guide- lines published in the Federal Register. The amendments clarify and expand the authorities of the Secretary and the eligible grantees, to serve dislocated defense workers with funds under Part B of Title III (the Secretary's National Reserve). Therefore, even though Department of Defense funds for these programs have already been obligated, Title IIIB funds can be used to fund new requests for DCA and DDP pro- grams. The amendments do not require any modifications to existing DCA or DDP grants, and they do not apply to funds under Part A of Title III (formula funds allotted to the States). Action Required: States should take actions necessary and appropriate to advise eligible grantees of the amendments to DCA and DDP under Title III of JTPA. States should also advise eligible grantees to continue preparing and submitting applications for DCA and DDP grants according to applicable guidelines.

References: None Background: PY 1996 Partnership Plan: Attached is the Partnership Plan that was developed in consultation with Section 401 grantees and Indian and Native American Advisory Council. The plan is comprised of several practical steps for continuing the overall improvement and results of the Indian and Native American Program. Federal Representative (Fed. Rep.) assignments: The three two- member Fed. Rep. teams that were established for PY 1995 remain the same for PY 1996: East Team: Ms. Dawn Bush and Mr. Guy Suetopka (Regions I-V), Midwest Team: Mr. Bob Lunz and Mr. Duane Hall (Regions VI-VIII), and West Team: Ms. Veronica Dabney and Ms. Athena Brown (Regions IX, X, Hawaii and Alaska). PY 1996 Master TAT Conference Calendar: The use of a Master Calendar continues to be necessitated by the need to efficiently use the limited national office and grantee program resources. It also encourages the expansion of technical assistance delivery at the multi-regional level: September/Tampa, Florida - Regions I-V; November/Sioux City, South Dakota - Regions VI-VIII; and February/California - Regions IX, X, Hawaii and Alaska. PY 97 Technical Assistance and Training (TAT): The Department, at the urging of grantees and the Council, will again seek grantee preference on the use of 1 percent or less of PY 1997 program funds for TAT purposes. Fifty-two percent of the grantees favored the use of program funds in PY 1996; however, forty-two percent of the grantees failed to provide a response. Review PY 1996 Partnership Plan TAT Goal for more details. Grant Management by Function: Several DINAP Fed. Reps. were assigned specific area responsibilities in PY 1995 that they continue responsibility for in PY 1996. Please contact the appropriate DINAP team member directly with questions related to: regulations, closeouts, P.L. 102-477, Payment Management System, Performance Standards, and on-site TAT (Mr. Greg Gross). School- to-work and youth issues (Ms. Veronica Dabney). New Directors' Manual (Ms. Dawn Bush). Electronic communications (Mr. Earl Mcletchie). GCMIS data (Mr. Guy Suetopka). Action. Review and assist with implementing the 1996 Partnership Plan's practical steps and goals. Questions: Contact your DINAP Federal Representative Team. THOMAS M. DOWD PAUL A. Average hourly wage at follow-up for Title III has been changed to "Hourly Wage at Follow-up". "Hours worked per week" has been added to complete the information needed to calculate weekly earnings. (These changes were necessary as SPIR information is by individual and to use a common concept here for Title II and III.) 18) Average number of weeks worked in follow-up period has been changed to "Number of Weeks Worked in Follow-up Period. (This change was necessary as SPIR information is by individual.) 19) Average hourly wage - preprogram for Title III has been changed to "Wage of the Job-of-Dislocation (Title III only)". 20) Preprogram wage has been redefined and as a separate line item on the SPIR applies to both Title II and Title III participants. 21) Concurrent participation has been expanded and may apply to both Title II and Title III participants. 22) Appendices, similar to those traditionally included with the JASR/WAPR, have been revised to more closely reflect the structure of the SPIR. Action Required: State Liaisons are requested to distribute the attached instructions to all officials within the State who need such information to implement the SPIR reporting requirements.

A. Report Outliers B. Report Edit Checks C. Guidance on the Single 90/30-Day Period of Inactive status. To obtain a copy of Attachments A and B, please contact Deloris Norris of the Office of Regional Management at (202) 219-5585. ATTACHMENT C: GUIDANCE ON THE SINGLE 90/30-DAY PERIOD OF INACTIVE STATUS The reporting instructions for the Federally required JTPA/EDWAA annual reports, issued under the provisions of Section 165 of the Act, are to be considered as extensions of JTPA legislation and regulations. The reporting requirement that a participant be terminated after last receipt of services, employment and/or training funded under the Act was adopted in the early years of JTPA's predecessor work/training programs. This was done after determination by monitors and auditors that some participants continued to be carried in an "active" or "inactive" status for two or three years after last contact with these programs. Input from States and prime-sponsors suggested that, after the investment of staff-time and program funds for the employment and/or training of a participant, a period of "inactive status", during which job development and job referral employability services might be offered, could enhance the number of terminees entering unsubsidized employment at termination. Commentors proposed varying periods of "inactive status", but the consensus was that a single period of up to 90 days after the last receipt of employment and/or training was sufficient. This limitation was made a part of the reporting instructions. Until PY 1990, a participant under Title II-A who had received SERVICES ONLY was to be terminated in a "reasonable" period of time, which was not further defined. At the request of a number of States and SDAs, "reasonable" for this purpose has been defined as a single period of up to 30 days after last receipt of SERVICES ONLY and this has been incorporated into the reporting instructions. If further training needs are identified and the participant's service strategy or Employability Development Plan (EDP) is amended, PRIOR TO LAST RECEIPT OF THE INITIALLY PLANNED TRAINING, the participant should be put into a "holding" status until the beginning of the next training component, rather than into "inactive status", which would trigger the clock for the single period of up to 90 calendar days of inactive status permitted after last receipt of planned training under Title II-A. When a decision is reached, sometime AFTER the participant has entered inactive status, to provide subsequent training; at the time such subsequent training begins, the 90-day clock stops. Upon last receipt of the subsequent training, the 90-day clock continues FROM THE POINT WHERE IT HAD STOPPED. After last receipt of planned Title II-A SERVICES ONLY, the participant enters inactive status and must be terminated within a single period of up to 30 calendar days. A decision to amend his/her EDP to provide training to such a participant, who has entered inactive status, would stop the 30-day clock. After last receipt of such planned training, the 90-day clock would be activated from zero. NOTE: After a participant who has received SERVICES ONLY has entered inactive status, a decision to provide additional Services ONLY extending beyond the allowable 30-day limit, prior to termination from the program, is NOT permitted. In Title III, after last receipt of either planned Basic Readjustment Service and/or Retraining, provision is made for a single period of up to 90 calendar days of inactive status prior to termination from the program. DOL/ETA does NOT grant waivers for the required termination of JTPA participants beyond the time periods specified above. In cases when a participant requires continued services after those provided during the single specified period of inactive status, when such services cannot be provided as post-termination services, and at termination from the program s/he meets the eligibility requirements for a given JTPA title, such individual may, after being terminated, be Re enrolled as a "new" participant in the JTPA funded title.
