The purpose of this joint issuance from the Assistant Secretary of the Employment and Training Administration and the Deputy Administrator of the Wage and Hour Division is to provide guidance to states that may be considering implementation of subsidized work-based training initiatives for unemployed workers, which could include claimants who are receiving unemployment compensation (UC), exhaustees of UC, and/or other unemployed workers who may not be eligible for UC. This advisory is intended to help states understand applicable Federal laws, regulations, and policies related to the Social Security Act and the Federal Unemployment Tax Act (which govern the Unemployment Compensation program), the Fair Labor Standards Act, and the Workforce Investment Act of 1998, as amended, as they develop and implement these types of initiatives.

This guidance announces the release of new UI DV Module 3 Web-based software that enables states to update and publish their state-specific instructions included in the Module 3 section of the UI DV Handbook, and that provides the means for states to certify to the Department of Labor (DOL) that their instructions are current. This guidance also establishes the timeframe to certify these data annually and indicates how users may establish accounts to use the Module 3 software.

To encourage the public workforce system to partner with TANF agencies in their efforts to promote subsidized employment opportunities allowable under the American Recovery and Reinvestment Act’s (ARRA) TANF Contingency funding for the creation and expansion of subsidized summer employment for low-income youth. To also encourage co-enrollment of youth in TANF and appropriate WIA programs so individuals can benefit from WIA services such as supportive services, occupational skills training, and other relevant services.

To provide an updated consolidated list of acceptable narrative reasons for separation from military service for UCX claims purposes.

To transmit a correction to the computation for State Workforce Agency usage in computing minimum weekly DUA amounts for all major disasters declared during the second quarter of Fiscal Year (FY) 2010. Incorrect dates were used to compute the average weekly benefit amount (AWBA). This issuance reflects the correct AWBA for the second quarter of FY 2010.

To respond to questions regarding the UI DV Program.

To invite the submission of proposals and funding requests from State Workforce Agencies to implement new UI REA initiatives or continue an ongoing REA initiative at the current or an expanded level; to provide guidelines for developing the proposals, and to provide criteria governing the use of these funds.

To advise states of findings resulting from an Office of Inspector General (OIG) audit of the Federal Additional Compensation (FAC) program and to remind states of FAC program instructions including: 1) establishing, recovering, and reporting any FAC overpayments, and 2) withholding income taxes from FAC upon a claimant’s election to have such taxes withheld.

To advise states of the extension of Emergency Unemployment Compensation, 2008 (EUC08) and the Federal Additional Compensation (FAC) programs, and the extension of the temporary provisions for the Federal-State Extended Benefits (EB) program, and to make a correction to UIPL No.12-09, Change 1.
