The intent of this guidance is to further clarify and consolidate changes to the performance reporting requirements for the American Recovery and Reinvestment Act of 2009. As such, this document replaces Training and Employment Guidance Letter (TEGL) 24-08, issued May 21, 2009.

To request Workforce Investment Act (WIA) Section 166 grantees to submit nominations for consideration by Secretary of Labor Hilda Solis, for appointment to fill expiring terms of membership on the Native American Employment and Training Council (Council).

To issue the revised federal poverty guidelines for the Senior Community Service Employment Program.

To provide clarification on match requirements and allowable construction costs under the YouthBuild Program.

To announce the National Rapid Response Initiative, a comprehensive, collaborative effort to promote consistent, high quality, timely and innovative responses to economic transition across the country. Through this Initiative, the Employment and Training Administration (ETA) will collaborate with state and local Rapid Response practitioners and partners to assess the current system capacity, identify areas for improvement, and provide training and technical assistance to support the system in addressing the identified needs.

Through this guidance, the Department of Labor is providing additional detail on the one-time availability of On-the-Job Training National Emergency Grants (OJT NEGs) funded with ARRA resources announced in Training and Employment Notice (TEN) 38-09.

To provide updated pages for the Unemployment Insurance (UI) Tax Performance System (TPS) Handbook, ET Handbook No. 407, 5th Edition.

To provide checklists of all currently active ETA Advisories as well as checklists of all ETA Advisories rescinded/cancelled since the previously issued checklists.

To advise states of the extension of and modifications to the Emergency Unemployment Compensation, 2008 (EUC08) program, the extension of the temporary provisions for the federal-state Extended Benefits (EB) program, and the expiration of the Federal Additional Compensation (FAC) program.

To announce the grant application process and to transmit guidance for the development, management, and delivery of state LMI/WI core and special information services to state and local workforce investment boards (WIBs), One-Stop Career Centers, and the job-seeking public.

To provide states with the amounts and formula methodology used in developing the FY 2010 second distribution.

To clarify the use of YouthBuild funds expended under the Program Year (PY) 2007 grant awards, PY 2008 grant awards, and PY 2009 grant awards.

To announce the release and availability of an ETA quantitative evaluation report: Use of One-Stops by Social Security Disability Beneficiaries in Four States Implementing Disability Program Navigator (DPN) Initiatives.

To assist the State Workforce Agencies designated by the Governors as “cooperating state agencies” (CSAs) for administration of the Trade Adjustment Assistance (TAA) program in implementing the funding and merit staffing of state administration provisions of the new regulations at 20 CFR Part 618, published on April 2, 2010 (75 Fed. Reg. 16988 - 17002).

To transmit the subject computation for State Workforce Agency usage in computing minimum weekly DUA amounts for all major disasters declared during the fourth quarter of Fiscal Year (FY) 2010.

To announce a partnership between the Employment and Training Administration (ETA) and the Institute of Museum and Library Services (IMLS) encouraging collaborations between the workforce investment system and public libraries aimed at improving the quality and quantity of employment and training services to job seekers and unemployed individuals.

To provide notice of final designation and funding allotments of WIA Section 166 grantees for the Supplemental Youth Services and Comprehensive Services (Adult) Program for PY 2010 through PY 2011.

To (1) inform states of amendments to the procedures to implement a program to recover unemployment compensation (UC) debt under the “Treasury Offset Program” (TOP) as well as provide the most current and accurate information on those procedures; and (2) reiterate the due process requirement for establishing that a debt is recoverable using the TOP.
