The intent of this guidance is to provide states with revised allotment levels for WIA Adult and Dislocated Worker Fiscal Year 2012 funds which became available to states in October 2011. The original TEGL 9-11 indicated a 1.503 percent temporary rate of operations reduction; Change 1 amends this to a 0.189 percent rescission providing all fifty states and territories with additional funding.

To provide information and procedural guidance to the State Workforce Agencies (SWAs) for processing requests for certification under the WOTC program after the December 31, 2011, expiration date for non-veteran target groups.

On October 21, 2011, President Obama signed the Trade Adjustment Assistance Extension Act of 2011 (TAAEA). To implement the TAAEA, this Training and Employment Guidance Letter (TEGL) announces the availability of revised Trade Adjustment Assistance Act (TAA) petition forms that must be used starting January 31, 2012. Downloadable and online petition forms currently in use will be rendered obsolete and may not be used as of that date. The Employment and Training Administration (ETA) will issue further guidance via another TEGL to instruct the State Workforce Agencies or agencies designated by Governors as "Cooperating State Agencies" (CSAs) (also jointly referred to as "states") to operate the Trade Adjustment Assistance (TAA) program under the Trade Act of 1974, as amended by the TAAEA (the 2011 Amendments).

This Training and Employment Guidance Letter (TEGL) Change 1 clarifies which programs or services must comply with the Selective Service registration requirements of the Workforce Investment Act (WIA) of 1998 § 189(h), codified at 20 CFR 667.250, and the Military Selective Service Act (50 U.S.C. App. 453), codified at 32 CFR Part 1605. This guidance clarifies that programs or services funded or authorized by Title I of WIA, not those funded or authorized solely by the Wagner-Peyser Act, must comply with the Selective Service registration requirements. This clarification replaces and supersedes prior guidance issued.

To provide State Workforce Agencies or agencies designated by Governors as “Cooperative State Agencies” (CSAs) (also jointly referred to as “states”) with the formula methodology used in developing the FY 2012 initial allocations, and to describe the process for states to use to request TAA program reserve funds for Training, Employment and Case Management Services, Job Search Allowances, and Relocation Allowances, including the State Administration of these benefits.

To ensure states are aware of the revised Schedule of Remuneration for the UCX program, which was issued December 29, 2011, and reflects the military pay increase effective January 1, 2012.

To advise states that the ETA 9000 report, “Internal Fraud Activities,” has been discontinued. Some of the information from the ETA 9000 report was merged into the ETA 227 Report, “Overpayment, Detection and Recovery Activities,” and additional changes to the ETA 227 Report were also made.

To ensure State Workforce Agencies are aware of the Federal military retired pay annual cost of living adjustment (COLA) provided by the Department of Defense.

To announce the release and availability of three new Employment and Training Administration (ETA) research reports related to summer and post-summer youth employment initiatives: (1) Using TANF Funds to Support Subsidized Youth Employment: The 2010 Summer Youth Employment Initiative; (2) Beyond a Summer Work Experience: The Recovery Act 2009 Post-Summer Youth Employment Initiative; and (3) Innovative Programs and Promising Practices: Indian and Native American Summer Youth Employment Initiatives and the 2009 Recovery Act.

To announce the release and availability of Employment Research In Brief:  An Annotated Bibliography of ETA-Sponsored Studies.

To ensure states are aware of the locality-based salary rates for certain Federal civilian employees.

To strongly encourage states to expend their allotment from the $500 million special distribution under the Recovery Act as quickly as feasible and prudent in accordance with the intent of the Recovery Act to preserve and create jobs and promote economic recovery.

To ensure states are aware that:
1) the social security survivors and old age retirement annuities and the Federal civilian pensions annual cost-of-living adjustment (COLA) will increase for calendar year 2012, and
2) COLA information may be found on the U.S. Office of Personnel Management (OPM) Web site.

1) To provide successful strategies to the public workforce system for connecting individuals with transportation to jobs and training, and
2) to help businesses access a diverse workforce.

To transmit the subject computation for State Workforce Agency usage in computing minimum weekly DUA amounts for all major disasters declared during the second quarter of Fiscal Year (FY) 2012.

To advise states of the latest extension of the Emergency Unemployment Compensation (EUC08) program and temporary Extended Benefit (EB) provisions.

To provide the state workforce agencies (SWAs) clarification on the use of documents used to verify eligibility for WOTC, in order to support the uninterrupted processing of American Recovery and Reinvestment Act of 2009 (Recovery Act) Disconnected Youth related eligible certification requests.
