This guidance is a reminder that funds authorized under section 7(a) of the Wagner-Peyser Act must be used to provide core services (as defined in section 134(d)(2) of the Workforce Investment Act of 1998 (WIA) (codified at 29 USC § 2864(d)(2)) and 20 CFR 662.240) and may be used to provide intensive services (as defined in section 134(d)(3)(C) of the WIA (codified at 29 USC § 2864(d)(3)(C)) and 20 CFR 663.200.)  This issuance also provides guidance to states to ensure that this flexibility does not compromise the purpose of the Wagner-Peyser Act.

To transmit the subject computation for State Workforce Agency usage in computing minimum weekly DUA amounts for all major disasters declared during the second quarter of Fiscal Year (FY) 2013.

To provide model legislation for states to use in implementing the provisions in Subtitle D of Title II of the Middle Class Tax Relief and Job Creation Act of 2012 on short-time compensation or “worksharing” programs, and to provide additional guidance to the state agencies about the new definition of short-time compensation in Federal unemployment compensation law.

In coordination with the SBA, the U.S. Department of Labor’s Employment and Training Administration (ETA) is pleased to announce the availability of a new SEA technical assistance Web site featuring resources from states that currently administer successful SEA programs, small business planning and start-up tools available through SBA, and much more to support states successfully implementing and operating an SEA program.  The Web site can be found here:  https://sea.workforce3one.org.

To provide the state workforce agencies (SWAs) final processing guidance on handling all timely filed certification requests received for new hires that began employment for an employer on or before December 31, 2010, and instructions for all paperwork associated with timely filed certification requests for new hires that began employment for an employer, under the expired groups, after December 31, 2010.

To invite states to enter into an Agreement with the Secretary of Labor (Secretary) to administer a temporary Federal Short-Time Compensation (STC) program under the Middle Class Tax Relief and Job Creation Act of 2012 (Act) and provide states with instructions for implementing and operating the program, including fiscal and reporting instructions.

To transmit the new EUC08 RES/REA required reports (ETA 9128u, Reemployment Services and Reemployment and Eligibility Assessments for EUC08 Claimants; and ETA 9002, EUC Quarterly Report Services to Participants & Performance Outcomes for Exiters)and reporting instructions to state workforce agencies.

To announce a streamlined process for American Job Centers, state workforce agencies, and workforce investment boards to become Employment Networks (ENs) under the Social Security Administration’s Ticket to Work and Self Sufficiency (TTW) program.

To inform the public workforce system about the pre-apprenticeship program definition and quality framework, as well as promote tools and materials to improve the consistency and quality of pre-apprenticeship programs.

To transmit a revised version of the State UI DV Operations Guide (ET Operations Guide 411)

To respond to questions from states about new requirements for the EUC RES/REA for certain recipients of EUC.

To inform the workforce investment system of the updated performance reporting requirements and revised associated timelines for the following Employment and Training Administration (ETA) programs and activities: 

• Quarterly and annual reports and data validation results for the Workforce Investment Act (WIA) Title IB programs and National Emergency Grants (NEGs);
• Quarterly reports and data validation results for the Wagner-Peyser Act Employment Service;
• Activities authorized under chapter 41 of title 38 United States Code (Local Veterans’ Employment Representative and Disabled Veterans’ Outreach Programs); and,
• The Trade Adjustment Assistance (TAA) program.

To provide further information to the workforce investment system about the importance of providing workforce, training, and referral services to victims of human trafficking and to give updated guidance on how to deliver these services under the Workforce Investment Act of 1998 (WIA), the Trafficking Victims Protection Act of 2000 (TVPA) and the Trafficking Victims Protection Reauthorization Acts of 2003, 2005 and 2008 (TVPRA).

To inform the public workforce system about the required process for outreaching to and tracking outcomes of VRAP participants. This includes how the Department of Labor (DOL) will make available VRAP participant information to the public workforce system and procedures for American Job Center (formerly One-Stop Career Center) staff to offer VRAP participants employment assistance upon program completion or termination as required by the VOW to Hire Heroes Act of 2011. This guidance also provides reporting specifications for reporting public workforce system outreach activities and the employment outcomes of VRAP participants.

To transmit the sixth edition of ET Handbook No. 301, BTQ Nonmonetary Determinations Quality Review.

To advise States of the changes to LERS necessary to implement Sections 211, 238, and 239 of the VOW to Hire Heroes Act of 2011 (VOW Act) and Section 2149 of the Middle Class Tax Relief and Job Creation Act of 2012, as well as for collecting performance data related to the Veterans’ Gold Card Initiative

To provide checklists of all currently active ETA Advisories as well as checklists of all ETA Advisories rescinded/cancelled since the previously issued checklists.

To advise state workforce agencies of the new provisions under the Middle Class Tax Relief and Job Creation Act of 2012 governing work search requirements for EUC recipients and state responsibilities for conducting random audits of recipients’ work search activities.

To provide a summary of selected ETA 581 data with associated charts and tables for CY 2011.
