Background. Mr. Dowd brings with him a sensitivity and a wealth of experience covering a wide variety of situations related to the Department's Indian and Native American programs. He has served in a numerous capacities, including both a local program operator and an advisory committee member. In addition, he has volunteered his time to work with many other grantees to improve their operations and in the conduct of the grantees annual meeting. Mr. Dowd will join the Department on or about August 1, 1994. He is currently completing work on a contract that he previously entered into in another capacity. We know you will join us in welcoming Mr. Dowd to this program. As Assistant Secretary Ross indicated in the satellite downlink at the 15th National Indian and Native American Employment and Training Conference, Mr. Dowd, as the new Chief, DINAP, will have direct access to his office on policy issues. The DINAP organization will continue to be housed within the Office of Special Targeted Programs. We look forward to working with Mr. Dowd as the Department continues to build upon present efforts in establishing a partnership which allows us to jointly serve our customers, Indians and Native Americans who need the assistance which our programs offer. Within the next few days, most section 401 grantees will be receiving their signed grant documents and Notices of Obligation (NOO's), which will authorize them to operate title IV-A programs for PY 1994. Most eligible grantees have already received signed Summer Plans and NOO's allowing them to operate title 11-B programs for the summer of 1994. Grantees who use the PMS to draw down their Job Training Partnership Act (JTPA) funds will need to use the following sub-account codes to draw down the appropriate funds. Grantees who continue to obtain their funds through the SF-270, Request for Advance or Reimbursement, will not be affected by this bulletin. Sub-account Code Instructions. The new sub-account code for PY 1994 title IV-A funds will be 5K (see attachment). As indicated last year in DINAP Bulletin No. 92-24, the subaccount code required to access title 11-B funds for the summer of 1994 is 3A. These sub-accounts correspond to the planning funding document (printout) transmitted to all grantees with Change 1 to DINAP Bulletin No. 93-15. All previously issued sub-account codes remain the same, including the "split" subaccounts for last summer's (1993) money. As a reminder, the subaccount code for PY 1992 title 11-B funds is lu, and the subaccount code for Fy 1993 title 11-B funds is 2W. Grantees are reminded that, when drawing down funds under either title, the oldest remaining funds should be drawn down first, so that as many subaccounts as possible can be "zeroed out." The only exception to this rule is when a grantee has been officially notified that it has exceeded the carry-in limit for a given funding period and, as a result, a specified amount previously allocated is no longer available to the program. In such cases, the Grant Officer will issue further instructions on a case-by-case basis. Action Required. Section 401 Indian and Native American grantees are requested to follow the instructions contained in section 4, above. Inquiries. Reference. DINAP Bulletin 93-11, Proposed Indian and Native American (INA) Automated Reporting System. Background. DINAP Bulletin 93-11 described the proposed INA Automated Reporting System and, at the joint national conference in Albuquerque during the Week of April 18, 1994, grantees were asked to volunteer to participate in a pilot program to test the system. We are pleased to announce that twenty-five grantees have expressed volunteered to participate in the pilot program which begins July 1, 1994. A list of these volunteer grantees is attached for your information. These grantees will submit their participant data under the new system on a quarterly basis and their financial data under the old system on a quarterly and annual basis. Please note the decision to change from terminee data to participant data; this is necessary to prevent the loss of data on participants who have not terminated. All other grantees will continue reporting as usual. Grantee computer capabilities have been identified through a survey conducted by CIMC, and our ADP contractor (Meridian) has begun to develop a cost-effective data transmission method for each grantee participating in the pilot. Action. It is not too late to submit your request to be included in the pilot project. DOL will still be able to use the data submitted even if grantees do not have their systems set up for the new ARS data format. JTPA regulations at 20 CFR 632.4 provide for the use of either of two sets of data in determining economically disadvantaged persons and program eligibility: the Health and Human Services Poverty Guidelines or the LLSIL. The attached Federal Register Notice (Vol. 57, No. 65) contains updated LLSIL and detailed instructions for their use, effective April 22, 1994. Action. Grantees will use one of the three tables on pages 19244 and 19245 of the Notice to find their 70 percent LLSIL for a family of four. Those grantees in one of the 25 Metropolitan Statistical Areas will use Table 3; grantees in Alaska or Hawaii will use Table 2; all other grantees will use Table 1. Grantees using Table 1 can find which region they are in by referring to the list on page 19242. Grantees using Tables 1 or 2 must also determine if they are in a metro or non-metro area; this information can be obtained from the grantee's State JTPA. Having found the applicable 70 percent LLSIL for a family of four on Tables 1, 2 or 3, the grantee can then find the 70 percent LLSIL for a family larger or smaller than four on Table 4 (page 19246). For example: a grantee in a non-metro area of Arizona is in the "West" region. On Table 1 its 70 percent LLSIL is 17,180. To find the applicable 70 percent for a family of six, the grantee finds 17,180 in column "four" of Table 4 and reads across that line to Column "six" to find 23,710. Grantees should note the disclaimer on page 19242 that the figures in this notice are valid only for eligibility determination under the JTPA and TJTC programs and should not be used for any statistical purposes. DINAP grantees are to disregard the instructions to Governors on page 19242 in the paragraph entitled "Use of These Data." Questions. Contact your DINAP Federal Representative.

Background. The conference is being sponsored as a joint project with the following agencies: U.S. Departments of Education, Division of Adult Education and Literacy, Office of Indian Education, Agriculture, Labor, Interior (BIA), and Health and Human Services. At the State level, the State Directors of Adult Education have been asked to coordinate the selection of "adult education teams" to attend the symposium. It is anticipated that twenty-five States will send representatives. The scheduling of this important symposium was coordinated with the Annual Conference on Indian Education which commences on October 15th in St. Paul. In order to ensure that key administrators attend from the Native American communities residing in each of these States, it will be necessary for you to contact the State Director of Adult Education to assist with the formation of the team. A list of State Directors of Adult Education is attached for your convenience. Also attached is a discussion on organizing an adult education team. The team composition will be comprised of four or five members representing these State agencies and additional four or five representatives from Native American tribes working in adult education and occupational training. This process of team selection will take place during a pre-symposium event coordinated by the State Director of Adult Education. During the pre-symposium meeting, strategies and activities for strengthening policies and partnerships at the symposium and follow-up activities will be identified. The Department of Education's Division of Adult Education and Literacy and Office of Indian Education is preparing a plan to distribute funds to each participating team to be used for the pre- symposium activity or underwriting travel costs to the symposium. Symposium Outcomes and Focus. The symposium's planning committee has identified two outcomes and four focuses which will be addressed at the two and one-half day event. They are as follows: a. Outcomes. (1) Create a national and local priority for Native American adult, cultural, technological, and career education and training. (2) Identify public policies/issues relating to resources, programming, and related services that support economic development and cultural literacy. b. Focus. In order to broaden the base of support, community to national-national to community, for Native American Adult Education, State teams will be formed to: (1) Improve the coordination and collaboration with Federal, State, regional, local and tribal agencies. (2) Establish cooperative agreements among all agencies providing adult education, employment and training for Native Americans. (3) Strengthen the partnerships that will allow every Native American adult increased education opportunity and to obtain necessary academic and technical skills to achieve personal goals, meaningful employment and exercise the rights and responsibilities of citizenship together with cultural awareness. (4) Support research and demonstration projects impacting on Native American adult and continuing education. Potential Benefits. Through attending this symposium, you and your team members will address national policies impacting the deliver of adult and job training programs to Native Americans. Special presentations by national experts on Native American education will look at trends affecting the future of these programs. You will have the opportunity to visits with model program personnel and build new partnerships to affect change in your program. Also, each State team will be involved in intensive planning sessions designed to identify barriers and formulate solutions which will enhance the quality of life for Native Americans. U.S. DEPARTMENT OF EDUCATION, DIVISION OF ADULT EDUCATION AND LITERACY Creating a Literate Future: A National Forum. on Strengthening Policies and Partnerships for Native American Adult and Occupational Education October 12 - 14, 1994 St. Paul, Minnesota Organizing an Adult Education Team The success of the symposium will depend on States and tribes identifying and selecting team members from the collaborating Federal/State/Tribal departments: Education, Labor, Health and Human Services, Interior (BIA), and Agriculture. Because the focus of the symposium is on policies and partnerships, the planning committee is urging that each State and tribe identify key administrators to represent these departments. The team will consist of up to ten individuals, five from State offices and five from tribal nations. Ideally the State administrators would be responsible for coordinating adult education and occupational services to the Native American communities at the State level. However, based on available funding and the demographics of a State, more team members, in particular Native Americans, may be necessary from States with large and diverse Native American populations. This is encouraged to ensure a successful symposium addressing the concerns of all Native American communities. (For purposes of clarification, the term Native American includes Alaskan Natives and Hawaiian Natives.) Funding for the symposium related activities will partially come from a federal stipend awarded to the participating States. The amount of the award will be based on the number of participating states. These funds may be used to sponsor the pre-symposium activity or to underwrite travel expenses. Additional funds will need to come from state and tribal resources. The participating state team members are encouraged to leverage dollars allocated for training to match the federal award. The following information is provided as a suggestion of activities which should be implemented to prepare for and as follow-up to the national symposium. Adult Education Team Activities Pre-symposium 1: Open invitation to all Native American communities to attend a meeting to discuss the symposium and select the delegation during the month of August 1994. Pre-symposium 2: Delegation meets as part of the team to work on preparation of materials to present at national meeting. This would include reviewing the briefing document. National Symposium: Delegation attends national symposium to develop an Action Plan in response to the theme of developing partnerships among agencies which will meet the goal of creating a literate future. Post-symposium: Delegation meets to implement the strategic planning process identified at the national symposium. Pre-symposium 1: Each State Director of Adult Education would notify in writing the key administrators in the State agencies and the tribal leaders for education and training inviting them to attend a pre-symposium meeting to discuss the upcoming event.in St. Paul. A list of tribal leaders is available from the Bureau of Indian Affairs, Washington, D.C. Examples of topics to be discussed at this meeting include the goals and focus of the symposium, State policies on adult education and training, funding, sources, demographics of the state, collaboration opportunities, and composition and selection of the state team. In addition, it may be helpful to select a team leader. Once the team is selected it should register for the symposium. Pre-symposium 2: Each member of the team would meet just prior to attending the symposium to review briefing document and to formulate their concerns and recommendations while attending the symposium. Final plans for funding would discussed and confirmed by the team leader. Each team member would be expected to compile pertinent information or resources to bring to the event. National Symposium: The team would participate in the daily activities which include examining national trends, cooperate in the forums with representatives from other States, contribute to the assemblies, identify opportunities for partnerships, and formulate a strategy or action plan for implementation in their respective State and tribes. Post-symposium: After returning home from the symposium, the teams would meet regularly to discuss their plan and implement the assigned action steps for collaboration among the agencies. In addition, the team would be encouraged to expand the network to include other providers and leaders within the area of adult education and occupational training. As a summary of activities, the team may want to consider developing a "white paper": based on the work begun at the symposium and continued throughout the year.

DINAP Bulletin 91-28 provided grantees with reporting instructions for Program Year 1991 (and 1992). Since then, the following definition changes have occurred. The definitions for VETERAN and for ICAPPED INDIVIDUAL have been enhanced for PY 1992 for JTPA Titles II-A, 11-B, III, and IV-A (Sections 401 and 402). The need for these changes is based on recent legislation enacted by the Congress. The definition of VETERAN was enhanced by adding language regarding via member of a reserve component under an order to active duty ... for which a campaign badge is authorized ... II. (This means that such an individual need not meet the more than 180 days of active duty criteria to be accorded veteran status.) (38 USC 2011(4)). The Americans with Disabilities Act (ADA) requires all Federally funded programs to adopt the definition contained therein for INDIVIDUAL WITH DISABILITY. For JTPA reporting purposes, ETA has inserted "which for such individual constitutes or results in a substantive barrier to employments into the definition specified in the ADA. These new definitions are on attached revised pages V-9 and V-11 of the Grantee Planning and Reporting instructions. Action. Grantees should remove the appropriate pages from the above mentioned instructions and replace them with the attached pages V-9 and V-11 (Rev.6/92) of the instructions for completion of Form ETA 8604, Annual Status Report. The INA program has traditionally used either of two methods in calculating income for the purpose of determining program eligibility - the past year (i.e., the last 12 months) and the prior six month period. This use of the past year method for calculating family income is consistent with the INA practice under the Comprehensive Employment and Training Act and was continued under the Job Training Partnership Act. When DINAP Bulletin No. 92-26 was issued to call attention to legislative requirements, this concern was not identified as an issue since the amendments did not affect this part of the definition Section 4(8)(B). Therefore, INA Section 401 grantees have continued to use both methods to calculate eligibility. This interpretation has proven critical to INA programs where seasonal work is the norm in many communities, especially as it applies to the summer program. However, DINAP has been advised that the INA program cannot continue to utilize the multiple methods for calculating income. As part of the revision of our regulations at 20 CFR 632, it has been called to our attention that the INA program is out-of-step with the JTPA requirements. Since this legislation is the source document in arbitrating any issue, the INA program must conform to the single method of calculating income - the prior six month period. Therefore, use of the past year method to calculate eligibility is incorrect and must be discontinued. Policy. Effective with the receipt of this bulletin, the INA Section 401 grantees must use the definition for economically disadvantaged contained in Section 4, of the Job Training and Partnership Act (see attachment). DEFINITIONS Sec. 4. For the purpose of this Act, the following definitions apply: (8) The term "economically disadvantaged" means an individual who (A) receives, or is a member of a family which receives, cash welfare payments under a Federal, State, or local welfare program; (B) has, or is a member of a family which has, received a total family income for the six-month period prior to application for the program involved (exclusive of unemployment compensation, child support payments, and welfare payments) which, in relation to family size, was not in excess of the higher of (i) the official poverty line (as defined by the Office of Management and Budget, and revised annually in accordance with section 673(2) of the Omnibus Budget Reconciliation Act of 1981 (42 U.S.C. 9902(2)), or (ii) 70 percent of the lower living standard income level; (C) is receiving (or has been determined within the 6-month period prior to the application for the program involved to be eligible to receive) food stamps pursuant to the Food Stamp Act of 1977; (D) qualifies as a homeless individual under subsections (a) and (c) of section 103 of the Stewart B. McKinney Homeless Assistance Act; (E) is a foster child on behalf of whom State or local government payments are made; or (F) in cases permitted by regulations of the Secretary, is an individual with a disability whose own income meets the requirements of clause (A) or (B), but who is a member of a family whose income does not meet such requirements.

References. None. Background. As previously announced by the Association for Farmworker Opportunity Programs (AFOP) at its May 1992 Board meeting, the Second National Conference on Migrant/Seasonal Farmworkers will be held May 10-13, 1993, in Denver, Colorado. Based upon the success of the initial joint conference in Buffalo, New York in 1991, leaders in Migrant Health, Migrant Education, Migrant Head Start and Farmworker Employment and Training agreed to stage joint conferences every 2 years as a means of fostering improved coordination and cooperation among all programs and agencies involved with farmworkers and farmworker issues. ETA Involvement. Representatives from the Division of Seasonal Farmworker Programs (DSFP), the U. S. Department of Education's Office of Migrant Education, National Association of Community Health Centers (Migrant Health Division), Housing Assistance Council, Inc., AFOP, and other agencies serve on the Executive Planning Committee (EPC) for the conference. As such, DSFP has agreed to support the purpose and goals of the joint conference, promote, and encourage attendance by Section 402-funded grantees, and coordinate the participation and involvement of other agencies of the U.S. Department of Labor in the conference. Call for Presentations. The EPC has developed the attached Call for Presentations. The DSFP and AFOP invite Section 402 employment and training and housing grantees to formally consider this request for proposal for joint conference presentations that would appeal to all conference participants. Action. Those grantees wishing to respond to the Call for Presentations should submit their proposal(s) and other information on the appropriate attached form in accordance with the instructions in the attachment. ATTACHMENT A C A L L F O R P R E S E N T A T I O N S The 1993 Joint Migrant and Seasonal Farmworker Conference will be held May 10-13, 1993, at the Denver Convention Center in Denver, Colorado. The Conference is cosponsored by the Migrant Education, Migrant Health, and farmworker employment and training Federal programs, and will represent the combined annual conferences for these programs. The conference theme is "Joining Forces - A Caring Commitment to Our Nation's Farmworkers." Participants will include administrators, public officials, teachers, early childhood specialists, health care providers, board members, management staff, field staff, MIS staff, fiscal staff, farmworkers, etc. While each program will have its own specific training workshops, a special emphasis will be placed on sessions which represent our common interests. The conference Executive Planning Committee is currently soliciting proposals for presentations that relate to this joint effort and that appeal to all conference participants. As is traditional for each of these programs, we are unable to pay honorariums, transportation expenses, etc., for the presentations. Attached is a Proposed Workshop Abstract Form.
