Closeout package cover letter dated June 30, 1995 Background: On October 18 and 19, 1995, a joint letter from the Division of Indian and Native American Program (DINAP) and the Employment and Training Administration's Office of the Comptroller/Division of Accounting was sent to all grantees that had not submitted a completed closeout package for JTPA Program Years 1991 thru 1994 nor requested an extension to complete the required documents. A similar letter was also sent to twelve grantees who had not submitted closeout packages for 99-7 grants, which should have been closed out four years ago. Since closeout packages were due within 90 days of receipt, all delinquent grantees were informed in the joint letter that unless they requested an extension from the Division of Accounting, all program funds would be frozen effective October 31. The affected grantees were given an opportunity to avoid a program interrup-tion by submitting all required documents to DOL on or before October 31, or by requesting an extension from the Division of Accounting, thereby establishing a new negotiated due date. Failure to meet an extended deadline would result in an immediate suspension of program funds. All of the grantees affected by the October 31 deadline either submitted a closeout package prior to the due date, or requested an extension. (A few grantees had already received extensions on their own prior to receiving the DOL letter.) Therefore, it was not necessary to freeze any grantee's funds at that time. Information: The due dates for grantees granted a one-time extension have now passed or are approaching quickly. Most grantees are responding in a timely manner, but there are still some delinquencies. Therefore, all grantees are advised that DOL policy is that grantees who fail to meet their new extended due dates will have their JTPA funds frozen WITHOUT ANY FURTHER NOTICE. No additional extensions will be granted. Funds will not be restored until a completed closeout package is submitted to the Division of Accounting. This policy will apply to all grantees immediately and without exception. Inquiries: All inquiries concerning the closeout process should be directed to the contact person cited in the closeout package transmittal letter. References. None. Background. The Department of Labor has an electronic bulletin board which contains a wide variety of statistical, employment, safety, health and pension information. The bulletin board, maintained by the Department's Office of Public Affairs, contains the latest news releases, fact sheets, speech texts and selected publications. It is available to anyone with a computer modem and communications software. Information available on the bulletin board includes consumer and producer prices, real earnings, employment and unemployment statistics, job safety and health regulations, job training and other department grants, wage-hour, pension and other enforcement actions. A nationwide listing of Federal job opportunities is also available. The attached press release on computer disks and substance abuse is an example of information on the board. Action. Grantees interested in accessing bulletin board data can self- register by calling 202/219-4784. Native American Cultural Heritage Month

Background. The U. S. Department of Labor's Native American Cultural Heritage Month Committee (NACHMC) concluded a very successful schedule of activities in the celebration of American Indian Heritage Month. This year's program highlighted American Indian cultural heritage through the creative talent of Indian youth. The committee sponsored an art and poetry contest based on the theme: "The Birth of the White Buffalo, A Celebration of the Partnership of All Peoples." Entries were solicited from Native American high school students throughout the country and judged by Indian artists, Indian educators, and volunteers from various government agencies and Departments. Results. The first place winner, Eric Moulton of the Confederated Salish and Kootenai Tribes in Montana, and second place winner, Jeremy Bisson also of the Confederated Salish and Kootnai Tribes, were flown to Washington, D.C. to receive their awards. Both winners received their awards from Ms. Cecilia Bankins, Deputy Assistant Secretary for Administration and Management, on November 30, 1995. Third place winners, Emily and Jeremiah Smith, Chippewa Indians from Cass Lake, Minnesota received a plaque, certificate and savings bonds. Three additional contestants were awarded Honorable Mention Certificates: fourth place, Sam Tenakhongva from Hopi, Arizona; fifth place, Sally Peltier from Turtle Mountain Band of Chippewa Indians, North Dakota; and sixth place, Lorinell Lomahaptewa from Hopi, Arizona. All contestants received Certificates of Appreciation. Entries were displayed in the Department of Labor's Great Hall. They formed the perfect cultural backdrop for the celebration. Inquiries. Background. DINAP reviews anually all bulletins issued since the inception of the Job Training Partnership Act for the purpose of identifying those that are needed by grantees for current program operations and those which may be eliminated. A listing of those which should be retained for operational purposes is attached. Action. Review all bulletins which have been issued since November 7, 1983 (DINAP BULLETIN 84-1) and insure that you have copies of those listed in the attachment. Contact your DINAP Federal Representative to obtain copies of those that are missing. It is recommended that you retain any bulletins which you believe may be needed for audit or close-out purposes, you may wish to retain bulletins that were issued primarily for informational purposes. Within the next few months, most section 401 grantees will be receiving their signed grant documents and Notices of Obligation (NOO's), which will authorize them to operate title II-B programs for the summer of 1995 and title IV-A programs for PY 1995. Grantees who use the PMS to draw down their JTPA funds will need to know and use the following subaccount codes to draw down the appropriate funds. Grantees who continue to obtain their funds through the SF-270, Request for Advance or Reimbursement, will not be affected by this bulletin. Action. The new subaccount code for PY 1994 title IV-A funds will be 6X. As indicated last year in DINAP Bulletin No. 93-18, Change 1, the subaccount code required to access title II-B funds for the summer of 1995 is 5J. These subaccounts correspond to the planning funding document (printout) transmitted to all grantees with DINAP Bulletin No. 94-18. All previously-issued subaccount codes remain the same, including the "split" subaccounts for title II-B funds for the summer of 1993. As a reminder, the subaccount code for PY 1993 title II-B funds is 3A, and the subaccount code for PY 1994 title IV-A funds is 5K. Grantees are reminded that, when drawing down funds under either title, the oldest remaining funds should be drawn down first, so that as many subaccounts as possible can be "zeroed out." The only exception to this rule is when a grantee has been officially notified that it has exceeded the carry-in limit for a given funding period and, as a result, a specified amount previously allocated is no longer available to the program. In such cases, the Grant Officer will issue further instructions on a case-by-case basis. Effective date. Date of this bulletin. Inquiries. Reference. DINAP Bulletin No. 87-11. Background. The JTPA Amendments of 1992 revised section 167 of the Act to require the Secretary of Labor to issue final regulations to clarify the application of the nondiscrimination and equal opportunity provisions of the JTPA and provide uniform procedures for implementing these provisions. On January 15, 1993, the Directorate of Civil Rights, the DOL agency responsible for enforcing the various Federal nondiscrimination and equal opportunity statutes applicable to federally-assisted programs, issued a final rule to implement the nondiscrimination and equal employment opportunity requirements of the JTPA in 29 CFR part 34. This final rule is in addition to the Department's nondiscrimination and equal opportunity regulations at 29 CFR parts 31 and 32. All three parts are applicable to JTPA, section 401 programs. In order to eliminate the burden of complying with other overlapping regulatory requirements, 29 CFR part 34 provides that compliance by JTPA grantees with part 34 constitutes compliance with the Department's Civil Rights Act of 1964 title VI regulations (29 CFR part 31) and with specified portions of the Department's Rehabilitation Act section 504 federally-assisted programs regulations (29 CFR part 32, subparts A, D and E). However, 29 CFR part 34 does not incorporate all of the requirements contained in 29 CFR part 32. Therefore, grantees remain responsible for the obligations imposed by subparts B and C and Appendix A of 29 CFR part 32, which pertain to employment practices and employment-related training, program accessibility, and accommodations under Rehabilitation Act section 504. Action. Grantees are to follow the regulatory requirements on nondiscrimination and equal opportunity contained in 29 CFR parts 31, 32 and the new part 34. Information. As a part of DINAP's continuing effort to provide customer service, we are pleased to announce that all Section 401 grantee reports and plans are to be submitted to a new MIS Desk. This newly established MIS operation within DINAP will provide a central entry point for all reports and plans submitted by grantees to the Department. It will also provide DINAP immediate access to program data updated daily. Ms. Andrea T.B. Brown, DINAP Assistant Manpower Development Specialist has been assigned responsibility for all MIS desk duties: receiving, tracking and logging reports, as well as creating a database by individual program and on an aggregate basis. Ms. Brown is also responsible for contacting grantees regarding missing and incorrect reports. Action. Reference. DINAP BULLETIN NO. 94-18 Background. On February 10, 1995, DINAP sent instructions for completing the Program Year 1995 Comprehensive Annual Plans and Calendar Year 1995 Summer Youth Plans to all grantees. In response to grantees requesting more time to develop their plans, DINAP issued the planning instructions earlier than in years past. The established due dates were set at April 7 for Summer Plans and April 21 for Comprehensive Annual Plans. Almost all grantees submitted their plans by the due dates or shortly thereafter; however, a few Summer Plans have yet to be received as well as several Comprehensive Annual Plans. Action. Grantees that have not submitted either or both of their plans must do so immediately. Plans submitted late will cause a delay in the review and funding process. More importantly, GRANTEES FAILING TO SUBMIT SUMMER PLANS and COMPREHENSIVE ANNUAL PLANS BY JUNE 30, 1995, WILL NOT RECEIVE FUNDING FOR THE CALENDAR YEAR 1995 SUMMER PROGRAM OR THE PROGRAM YEAR 1995 REGULAR PROGRAM. Furthermore, grantees operating Title II-B summer programs or Title IV-A programs without Department-approved plans will not be reimbursed for any associated costs. If for any reason a grantee feels they will be unable to meet the June 30 deadline, they are advised to contact the Chief of DINAP immediately.
