Dear Ms. McCabe:

This is in response to your continuing hardship exemption request for Boston Newspaper Guild, LM File Number 027-480, for the fiscal year ending September 30, 2010. Your request dated January 27, 2011 was received by the Office of Labor-Management Standards (OLMS) on January 28, 2011. A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.

You based your request upon the following information stated in your letter:

Your accountant prepared your LM-2 using the Adobe version of the form rather than the new web-based version. While your president was able to successfully sign the form electronically, you are unable to do so because neither the Boston Newspaper Guild’s nor your own personal computer will accept the version of Adobe required to file the form. You contacted the Department for help but were still not successful.

OLMS grants your continuing hardship exemption request for filing the Form LM-2 electronically for the fiscal year ending September 30, 2010, based on the technical difficulties that you encountered. Please have both officers sign your completed hardcopy Form LM-2 report and mail it to the OLMS Division of Reports, Disclosure and Audits at the following address:
