Dear Mr. Bruening:

This office has recently completed an audit of Mine Workers Local 6410 under the Compliance Audit Program (CAP) to determine your organization’s compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). As discussed during the exit interview with you and Financial Secretary Roger Bouch on May 4, 2016, no violations of the LMRDA were disclosed in areas of financial activity included in the CAP. This does not exhaust all possible problem areas, however, since the audit conducted was limited in scope and did not include all areas of your union’s operation.

Because your organization no longer represents working members by participating in collective bargaining, your local no longer meets the definition of a labor organization under the LMRDA. Therefore, Local 6410 can file a terminal annual financial report, form LM-3 or LM-4, and then stop filing annual financial reports. And, unless required by your International Union, you are not required to have bonding coverage.
