MERRILLVILLE, Ind. – The U.S. Department of Labor has sued Family Mobile Medical Services Inc. of Merrillville and owner Ben Richmond to restore $8,965.94 in voluntary employee contributions plus interest to the company’s retirement plan. The case resulted from an investigation by the Labor Department’s Employee Benefits Security Administration into alleged violations of the Employee Retirement Income Security Act.

TACOMA, Wash. – The U.S. Department of Labor has obtained a default judgment ordering Vincent’s Apartment Washer Service Inc. and its former owner and president, Keith D. Vincent, to restore $16,939 to the company’s savings incentive match plan for employees.

PHILADELPHIA — The U.S. Department of Labor has obtained a default judgment appointing an independent fiduciary to manage the employee retirement savings plan of defunct Janbridge Inc., formerly located in Philadelphia.

Under the judgment, entered in the U.S. District Court for the Eastern District of Pennsylvania, Metro Benefits Inc. of Pittsburgh was appointed as the independent fiduciary with authority to manage the plan, distribute assets to plan participants and beneficiaries, and terminate the plan.

MERRIVILLE, Ind. – The U.S. Department of Labor has sued Subspecialty Centers of America LCC in Merriville and the defunct company’s owner, Mark S. Weinberger, for allegedly failing to administer and terminate the Subspecialty Centers of America LCC 401(k) Plan and Trust in violation of the Employee Retirement Income Security Act.

NEW YORK – The U.S. Department of Labor has obtained a court order appointing an independent fiduciary to manage the abandoned 401(k) plan of Swigonski Management Group, formerly located in Sherrill.

LOS ANGELES – The U.S. Department of Labor has sued USA Star Healthcare Group - East Los Angeles Inc. and executives of ElaStar Community Hospital for failure to remit and timely forward employee contributions and loan repayments to the hospital’s retirement plan in violation of the Employee Retirement Income Security Act. The company also operated under the name ElaStar Community Hospital.

MIAMI – The U.S. Department of Labor has obtained a consent judgment that restores more than $107,775 to participants in the Miami-based Michigan Drill Corp. Profit Sharing Plan.

BURNSVILLE, Minn. – A federal district court in Minneapolis has ordered Larry Lauterbach, the president and former owner of Slate Cement Inc., a defunct Burnsville construction company, to restore $17,273.18 in unremitted employee contributions and lost opportunity costs to the company's health and dental plan, and $747.20 in unremitted employee contributions to the company's 401(k) plan.

MENTOR, Ohio – The U.S. Department of Labor has sued the trustee of the North Coast Wood Products Profit Sharing Plan, Harry Fishleigh III, for improperly transferring $96,837.63 in plan assets to his son, Steven Fishleigh, in violation of the Employee Retirement Income Security Act.

BOSTON – The U.S. Department of Labor has sued Stephen Thomas, individually and as trustee of the defunct Gagne Precast Concrete Products Inc. Employee Stock Ownership Plan, for alleged violations of the Employee Retirement Income Security Act that cost the plan millions of dollars in losses. ERISA is the federal law that protects the assets and participants of private sector employee benefit plans.

INDIANAPOLIS –– The actions of the U.S. Department of Labor have ensured that $51,933.26 of un-remitted employee contributions and related lost opportunity costs have been returned to the Premier Properties USA Inc. 401(k) plan.

ALTUS, Okla. – The U.S. Department of Labor has obtained a consent judgment and order permanently barring the owner of defunct Quartz Mountain Aerospace Inc., which operated in Altus as well as in Coffeeville, Kan., from serving in a fiduciary capacity to any employee benefit plan unless he obtains fiduciary training by Jan. 31, 2012.

CINCINNATI – The third-party administrator to 56 employee benefit plans – most covered by the Employee Retirement Income Security Act – located throughout Ohio and several other states pleaded guilty to one count of embezzlement of $1 million in assets from 12 retirement plans.

The additional locations of the plans are Beth Park and Ford City, Pa.; South Plainfield, N.J.; Waltham, Mass.; Anderson, Ind.; Saco, Maine; and Orange Beach, Ala.

CHARLESTON, W.Va. – The U.S. Department of Labor has obtained a court judgment appointing an independent fiduciary to manage the retirement savings plan of Shawnee Hills Inc., a defunct mental health hospital formerly located in Charleston.

Under the judgment, entered in the U.S. District Court for the Southern District of West Virginia, G Trust of Topeka, Kan., was appointed as the independent fiduciary with authority to manage the plan, distribute assets to plan participants and beneficiaries, and terminate the plan.

PITTSBURGH – The U.S. Department of Labor has sued Liberty-Pittsburgh Systems Inc. of Pittsburgh and its chief executive officer, Kevin T. Weir, for failing to remit employee contributions to its 401(k) plan in violation of the Employee Retirement Income Security Act.

The lawsuit alleges that from January 2007 through December 2009 the defendants failed to remit employee contributions or participant loan repayments to the plan, and remitted certain contributions and loan repayments to the plan late without interest.

NEW CASTLE, Del. – The U.S. Department of Labor has obtained a consent judgment ordering Arkion Life Sciences LLC and its corporate officers, Earnest W. Porta, Rick, L. Stejskal, Harvey L. Weaver and Anthony J. Simei, to restore $193,795 in restitution and interest to the company's 401(k) plan.

PROVIDENCE, R.I. – The U.S. Department of Labor has obtained a court judgment and order appointing an independent fiduciary to manage the 401(k) plan of defunct BlueSky Brands Inc. of Westerly, R.I. The judgment and order resolve a lawsuit filed by the Labor Department against the company for violations of the Employee Retirement Income Security Act.

JANESVILLE, Wis. – The U.S. Department of Labor has sued Premier Vending Inc. of Janesville and its president and co-owner, David R. Biggerstaff, to restore $26,163.50 to the company’s 401(k) plan in voluntary employee contributions, plus lost interest. The case resulted from an investigation by the Labor Department’s Employee Benefits Security Administration into alleged violations of the Employee Retirement Income Security Act.

MINNEAPOLIS – A federal district court in Minneapolis has granted the U.S. Department of Labor's motion for summary judgment requiring Copy Cat Business Systems Inc. and its former owners, Susan Blackford and Joel Blackford, to repay $13,218.76 in employee contributions and lost interest owed to the company's savings incentive match plan for employees individual retirement account. The court's decision resolves a lawsuit filed by the Labor Department against the defendants for alleged violations of the Employee Retirement Income Security Act.
