  Employees, AFL-CIO, Local 2425
385 Tremont Avenue
East Orange, NJ 07018

Dear Ms. Williams:

This is in response to your continuing hardship exemption request for American Federation of Government Employees, AFL-CIO, Local 2425, LM File Number 542-643, for the fiscal year ending December 31, 2008.  Your request dated May 19, 2009 was received by the Office of Labor-Management Standards (OLMS) on May 20, 2009.  A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.

You based your request upon the following information:

Your accountant’s computer, used for processing your Form LM-2, was attacked by a virus which affected their ability to properly service their clients.  It is your intention to have your Form LM-2 electronically filed by June 30, 2009.

OLMS grants your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending December 31, 2008, based on the information provided, until June 30, 2009.  If you have not already done so, please file a signed paper version of your Form LM-2 as soon as possible as it was due by March 31, 2009.  Until this report has been received, your union will be considered delinquent in its filing.

If you have any further questions about filing Form LM-2 pursuant to the hardship exemption, please call 202-693-0123 and reference your organization’s LM file number.

Sincerely,

Andrew R. Davis, Chief
Division of Interpretations
