This office has recently completed an audit of Steelworkers Local 4427 under the Compliance Audit Program (CAP) to determine your organization's compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). As discussed during the exit interview with Donald Fusselman on February 28, 2007, the following problems were disclosed during the CAP. The matters listed below are not an exhaustive list of all possible problem areas since the audit conducted was limited in scope.
The CAP disclosed a violation of LMRDA Section 201(b), which requires labor organizations to file annual financial reports accurately disclosing their financial condition and operations. The Labor Organization Annual Report (Form LM-3) filed by Local 4427 for fiscal year ending December 31, 2006 was deficient in the following areas:
- Local 4427 failed to report the number of members in their organization at the end of the reporting period in Item 19.
- Local 4427 overstated Total Receipts in Item 44 by $75.00 and overstated Total Disbursements in Item 55 by $75.00.
Local 4427 has submitted an amended 2006 LM-3 Report to the Cleveland District Office correcting these reporting errors. Therefore, no further action is being considered regarding these violations at this time.
