Dear Mr. Bales:
This office has recently completed an audit of UAW Local 2374 under the Compliance Audit Program (CAP) to determine your organization’s compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). The matters listed below are not an exhaustive list of all possible problem areas since the audit conducted was limited in scope.
Reporting Violation
The audit disclosed a violation of LMRDA Section 201(b), which requires labor organizations to file annual financial reports accurately disclosing their financial condition and operations. The terminal Labor Organization Annual Report Form LM-3 was not filed by Local 2374 for fiscal year 2009.
Local 2374 must file a terminal Form LM-3 for the fiscal year beginning January 1, 2009 and ending the month and day your union terminated. I am providing you with a blank form and instructions, and advising you that the reporting forms and instructions are available on the OLMS website (www.olms.dol.gov). The terminal Form LM-3 should be submitted to this office at the above address as soon as possible, but not later than November 1, 2010. Before filing, review the report thoroughly to be sure it is complete, accurate, and signed properly with original signatures.
