Monterey taqueria to return $36K in unpaid overtime wages, damages to 11 employees
Employer: Papa Chano’s LLC, doing business as Taqueria Papa Chano’s
Site: One restaurant in Monterey, California, owned by Everardo Valle and Sergio Valle.
Investigation findings: Taqueria Papa Chano’s failed to pay the overtime premium of time and one half for all hours worked beyond 40 in a workweek, as required by the Fair Labor Standards Act. Investigators from the Wage and Hour Division’s San Francisco District Office found $36,026 in overtime back wages and damages due to 11 workers. The employer also failed to keep accurate records of hours worked.
Resolution: The employer has agreed to pay all wages and damages due and has signed a consent judgment in the U.S. District Court for the Northern District of California. The employer will post the terms of the consent judgment in English and Spanish at the restaurant and will provide contact information for the Department of Labor to employees.
Quote: “Restaurant workers are particularly vulnerable to unfair labor practices. They must be paid as the law requires for all hours worked,” said Susana Blanco, the division’s district director in San Francisco. “The Wage Hour Division will use all available tools to protect workers and level the playing field for employers”
