Florence, Texas, workers to recover more than $364,000 in overtime back wages


Employer agrees to pay overdue wages following US Department of Labor investigation

FLORENCE, Texas -- One hundred and sixty-nine current and former quarry workers at Florence-based Cobra Stone Inc. will receive $364,403 in overtime back wages following a U.S. Department of Labor investigation that found the employees were not properly paid as required by the Fair Labor Standards Act.

The investigation by the Labor Department’s Wage and Hour Division in San Antonio, Texas, found that Cobra Stone did not properly pay its employees overtime for hours worked over 40 in a week.

“Cobra Stone employees are entitled to time and one-half their regular rates of pay for the overtime hours they work,” said Cynthia Watson, regional administrator in the Southwest for the Wage and Hour Division. “The Labor Department’s Wage and Hour Division is committed to protecting the rights of workers by ensuring they receive the wages to which they are entitled.”

Cobra Stone produces and provides natural stone for commercial and residential construction projects. The company has agreed to future FLSA compliance.

The FLSA requires that covered employees be paid at least the federal minimum wage of $7.25 for all hours worked, plus time and one-half their regular rates of pay, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Employers must also maintain accurate time and payroll records.
