Staffing agency in Pearland, Texas, to pay nearly $18,000 to 8 computer programmers, system analysts following US Labor Department investigation
PEARLAND, Texas -- Computer Careers and Consulting Inc. in Pearland has agreed to pay $17,831 to computer programmers and system analysts after an investigation by the U.S. Department of Labor’s Wage and Hour Division found that eight employees were not properly paid in accordance with the H-1B provisions of the Immigration and Nationality Act.
“The employer did not provide the work promised or the wages employees were to receive as required by the H-1B program,” said Cynthia Watson, the Wage and Hour Division’s regional administrator in the Southwest. “These illegal practices will not be tolerated.”
The investigation by the division’s Houston office found that Computer Careers and Consulting failed to pay for periods of time when employees were hired to work but not given work to do, made impermissible deductions from employees’ wages, and failed to accurately specify and provide the correct prevailing wage on labor condition applications.
Computer Careers and Consulting provides computer programmers and system analysts to clients in the Greater Houston metropolitan area.
The H-1B visa program allows non-immigrant foreign workers in professional occupations, such as computer programmers, engineers, medical doctors and teachers, to enter the United States and work temporarily. By law, H-1B workers are to be paid the same wage rates and benefits as those paid to workers in the United States already doing the same jobs in the same geographic areas. H-1B workers must be paid the required wage rate for all nonproductive time caused by conditions related to employment, such as lack of assigned work.
