US Labor Department investigates Sealed Rite, finds more than $67,000 in overtime back wages due for 21 workers at construction company

FORTVILLE, Ind. -- Sealed Rite Inc. has agreed to pay 21 workers a total of $67,245 in back wages following an investigation by the U.S. Department of Labor’s Wage and Hour Division. The investigation found violations of the Fair Labor Standards Act’s overtime provisions at the Fortville precast construction company.

“Failing to pay overtime is one of the most common violations we find,” said Patricia Lewis, the division’s district director in Indianapolis. “Other employers should take this opportunity to ensure that their pay practices comply with federal law. The department is committed to ensuring workers receive the wages they have rightfully earned, and that hard-working, middle-class Americans are not exploited in the workplace.”

The investigation determined that Sealed Rite Inc. failed to pay employees overtime compensation at time and one-half their regular rates of pay for hours worked beyond 40 in a workweek. Instead, employees were paid straight time for all hours worked.

The company has agreed to pay the back wages in full, and has agreed to comply with the FLSA in the future.

The FLSA requires that covered, nonexempt employees be paid at least the federal minimum wage of $7.25 per hour for all hours worked, plus time and one-half their regular rates, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Employers also are required to maintain accurate time and payroll records.
