Statement of Reasons
For Dismissing a Complaint Concerning the Trusteeship imposed on
Local 693, Laborers International Union of North America, AFL-CIO,
On September 18, 2013 in Collins, Mississippi

A member in good standing of the Laborers, Local 693 (Local 693), filed a complaint, on July 3, 2014, with the Secretary of Labor alleging that the trusteeship imposed on Local 693 by Laborers International Union of North America (LIUNA) was not established in accordance with the union’s constitution and bylaws and violated Title III of the Labor-Management Reporting and Disclosure Act of 1959, as amended (LMRDA), 29 U.S.C. § 462.

The Department’s investigation established that on July 17, 2015, LIUNA reported that Local 693 had neither members nor collective bargaining responsibilities. Accordingly, LIUNA terminated the trusteeship. On October 13, 2015, a Terminal Trusteeship Report Form LM-16 was filed with the Department.

For the reasons set forth above, any questions regarding the use of proper procedures and whether the trusteeship was valid are moot. Accordingly, the Department has concluded that this matter does not require any further action on the part of the Department, and we are closing our file.

This is to advise you of the disposition of your complaint filed with the Secretary of Labor alleging that violations of Title III of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA), occurred with respect to a trusteeship imposed by the Laborers’ International Union of North America (LIUNA) over Local 693 in Collins, Mississippi.

An investigation was conducted by OLMS. After carefully reviewing the investigative findings, we have determined that legal action is not warranted in this case. Therefore, we are closing our file as of this date.

The basis for this decision is set forth in the enclosed Statement of Reasons.

This is to advise you of the disposition of a complaint filed with the Secretary of Labor alleging that violations of Title III of the Labor-Management Reporting and Disclosure Act of 1959, as amended (LMRDA), occurred with respect to the imposition of a trusteeship by the Laborers' International Union of North America (LIUNA) over Local 693 in Collins, Mississippi.

Pursuant to Section 304 and 601 of the LMRDA, an investigation was conducted by the Office of Labor-Management Standards. After carefully reviewing the investigative findings, and after consulting with the Solicitor of Labor, we have determined that legal action is not warranted in this case. We are, therefore, closing our file as of this date.
