DETERMINATION
Determination of a Complaint Filed under Title IV
of the Labor-Management Reporting and Disclosure Act of 1959
On November 23, 2008, the Secretary of Labor received a complaint alleging violations of Section 302 of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA), regarding a trusteeship imposed on May 22, 2007 on UA Local 211 in Houston, Texas.
Pursuant to Sections 304 and 601 of the LMRDA, the Department of Labor conducted an investigation. The investigation disclosed that the UA did not continue its trusteeship over Local 211 beyond 18 months for a purpose allowable under Section 302.
Apprised of these findings, agreed to conduct an election and terminate the trusteeship. The agreed upon election was concluded on June 16, 2009 and the trusteeship terminated on July 7, 2009. It is, therefore,
DETERMINED, that there is probable cause to believe that violations of Title III of the LMRDA occurred by continuing the trusteeship imposed on UA Local 211 on May 22, 2009, but that these violations have been remedied by the termination of the trusteeship on July 7, 2009.
Therefore, civil action under Section 304(a) of the LMRDA to terminate the trusteeship imposed on May 22, 2009 is not warranted.
