NOTICE TO LABOR ORGANIZATIONS OF FTA APPLICATION FOR ASSISTANCE UNDER THE OTHER THAN URBANIZED OR OVER-THE-ROAD BUS ACCESSIBILITY PROGRAMS 49 U.S.C. § 5311
Below are grants awarded by the Federal Transit Administration.
Pursuant to the Department of Labor’s procedural Guidelines, 29 CFR § 215.3, as amended, 73 Fed. Reg. 47,046, 47,056 (Aug. 13, 2008), grants of assistance under the Other Than Urbanized and Over-the-Road Bus Accessibility programs are certified under the terms and conditions of a Special Warranty Arrangement (Warranty) without a referral. This Arrangement provides transportation-related employees in the service area of such project protections satisfying the requirements of the Federal transit law, 49 U.S.C. § 5333(b). Employees in the service area of the project are intended third-party beneficiaries to the Warranty referenced in the grant contract between the Grantee and the U.S. Department of Transportation, and the parties to the contract so signify by executing that contract. Such employees are also beneficiaries of the protective arrangements referenced in any subsequent contracts between the Grantee and any Recipients. Employees not represented by any labor organization, or if so represented through their representative on their behalf, may assert claims with respect to the protective arrangements under this provision.
