Dear Mr. Sweeney:

This office has recently completed an audit of Iron Workers AFL-CIO under the Compliance Audit Program (CAP) to determine your organization’s compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). As discussed during the exit interview with you on June 27, 2012, the following problems were disclosed during the CAP. The matters listed below are not an exhaustive list of all possible problem areas since the audit conducted was limited in scope.

Failure to Conduct Election

During the audit, it was discovered that the District Council had failed to conduct its regularly scheduled election of officers in December 2011 in violation of Article IX, Section 3 of the Constitution and Bylaws of the Philadelphia District Council and Vicinity and Title IV of the LMRDA. The Council has since conducted an officer election and provided evidence of this to the Office of Labor-Management Standards (OLMS). Based upon your assurance the District Council will conduct officer elections in the month of December every four years in compliance with the constitution and bylaws, OLMS will take no further enforcement action regarding the above violation.
