Today, March 15, 2010, the Department of Labor's final rule for the H-2A temporary agricultural worker program became effective. Under the Immigration and Nationality Act, the Department of Labor must ensure that both U.S. and foreign workers are protected from unfair employment practices. The Final Rule reflects the Administration's commitment to ensure a fair wage and strong labor protections for all workers. Among many other provisions, this rule:
- raises wages for workers by reinstating the use of USDA wage surveys
- provides transparency by creating a national electronic job registry where job orders will be posted by the Department
- ensures that every foreign worker has a copy of their job order before they leave their home country
- increases oversight and enforcement powers to ensure that the worker protection requirements of the H-2A program are enforced.
