Certification Regarding Eligibility to Apply for
Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility for secondary workers to apply for
Trade Adjustment Assistance, the group eligibility requirements of
paragraph (a)(2)(C) of Section 222 of the Trade Act, as amended,
must be met. It is determined in this case that the requirements of
(a)(2)(C) of Section 222, as amended, have been met.
The investigation was initiated on January 16, 2003, in
response to a petition filed by a company official on behalf of
workers of Moll Industries, Davie, Florida. The workers produce
components for telecommunications products.
The investigation revealed that Moll Industries, Davie,
Florida produces components for telecommunications which it
supplies to manufacturers of two-way radios, and a loss of
business with this/these manufacturer(s) contributed importantly
to the workers separation or threat of separation.
Evidence revealed that Motorola, Inc., Plantation, Florida
to whom the petitioning workers' firm or subdivision supplies the
aforementioned components, employed a group of workers who
received a certification of eligibility for adjustment
assistance, and such supply or production is related to the
article that was the basis for such certification. Motorola,
Inc., Plantation, Florida increased their reliance on imported
two-way radios and greatly reduced purchases of components from
the petitioning workers' firm. The subject firm's employment
declined, in part, because of those customer imports. Workers of
Motorola, Inc., Plantation, Florida were certified as eligible to
apply for Trade Adjustment Assistance on August 30, 2002 (TA-W-
41,780).
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Moll Industries, Davie,
Florida qualify as adversely affected secondary workers under
Section 222 of the Trade Act of 1974, as amended. In accordance
with the provisions of the Act, I make the following certification:
"All workers of Moll Industries, Davie, Florida who became
totally or partially separated from employment on or after
November 22, 2001, through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, as amended"
