Request for Information: Labor Certification for Permanent Employment of Foreign Workers in the United States; Modernizing Schedule A to Include Consideration of Additional Occupations in Science, Technology, Engineering, and Mathematics (STEM) and Non-STEM Occupations

NOTICE: On December 15, 2023, the Department of Labor (Department) announced issuance of a Request for Information (RFI), Labor Certification for Permanent Employment of Foreign Workers in the United States; Modernizing Schedule A to Include Consideration of Additional Occupations in Science, Technology, Engineering and Mathematics (STEM) and Non-STEM Occupations. The RFI solicits from the public any input, including data, statistical metrics or models, studies, and other relevant information, on how the Department may establish a reliable, objective, and transparent methodology for revising Schedule A to include STEM and other non-STEM occupations that are experiencing labor shortages, consistent with requirements of the Immigration and Nationality Act (INA).

The publication of the RFI in the Federal Register, on December 21, 2023, fulfills one of the President’s initiatives regarding artificial intelligence, as directed in Section 5.1(e) of Executive Order 14110, Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence.

The Department invites the public to comment on the RFI, which will remain open for 60 days for comment through February 20, 2024.

Anyone who submits a comment (including duplicate comments) should understand and expect that the comment, including any personal information provided, will become a matter of public record and will be posted without change to www.regulations.gov.
