One Clothing ordered to pay more than $55,000 in back wages and penalties resulting from U.S. Department of Labor investigation


LOS ANGELES -- Eighty-eight garment workers will receive back wages totaling $55,152 under terms of a consent judgment resolving a lawsuit filed by the U.S. Department of Labor in the U.S. District Court for the Central District of California.

The suit followed an investigation of O & K Inc., doing business as One Clothing, by the Labor Department’s Wage and Hour Division’s East Los Angeles District Office. The company has agreed to pay the back wages owed to employees of sewing contractors who produce ladies junior wear at several locations in the Los Angeles area.

“We’re pleased that the Wage and Hour Division’s enforcement efforts resulted in the recovery of proper back wages for these vulnerable workers,” said District Director Donald Wiley.

The investigation revealed that the employees were not paid overtime compensation as required under the Fair Labor Standards Act (FLSA). Also, the company was in violation of the act’s recordkeeping provisions.

In addition to the payment of the back wages, One Clothing has agreed to pay a civil money penalty of $990 that was assessed by the department for violation of the child labor provisions of the FLSA.

The FLSA requires that covered employees be paid at least the federal minimum wage for all hours worked, and time and one-half their regular rates of pay for hours worked over 40 per week. Employers must also maintain accurate time and payroll records. The federal minimum wage for covered, nonexempt employees is $6.55 per hour. Effective July 24, 2009, the minimum wage will increase to $7.25 per hour.
