BCI Technologies of Grand Prairie, Texas, pays more than $248,000 in overtime back wages following US Labor Department investigation

GRAND PRAIRIE, Texas -- BCI Technologies of Grand Prairie, Texas, has paid $248,192 in overtime back wages to 126 former and current employees after an investigation by the U.S. Labor Department found the workers were not properly paid overtime as required by the Fair Labor Standards Act.

“Employees are entitled to receive the wages they have rightfully earned,” said Cynthia Watson, regional administrator for the department’s Wage and Hour Division in the Southwest. “In this case, employees often worked more than 40 hours per week and were not properly compensated for it. This is both illegal and unacceptable.”

The investigation by the Dallas office of the Wage and Hour Division found that BCI Technologies, which provides installation and service of fire and security alarms to commercial customers, misclassified employees as exempt, and paid a straight salary without regard to the number of hours worked in a workweek. The company also failed to maintain the required recordkeeping.

The FLSA requires that covered employees be paid at least the federal minimum wage of $7.25 for all hours worked, plus time and one-half their regular rates of pay, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Employers are also required to maintain accurate time and payroll records.
