Castillo Ready Mix in Belen, NM, agrees to pay more than $147,000 to 87 construction workers following US Labor Department investigation
BELEN, N.M. -- Castillo Ready Mix Inc. in Belen has agreed to pay $147,568 in back wages to 87 current and former construction workers following an investigation by the U.S. Department of Labor’s Wage and Hour Division that disclosed overtime violations of the Fair Labor Standards Act.
“These workers should have been paid the wages they worked hard for and deserve,” said Cynthia Watson, the Wage and Hour Division’s regional administrator in the Southwest. “In this case, employees worked up to 75 hours a week without receiving the overtime compensation they were entitled to. That is completely unacceptable.”
An investigation by the Wage and Hour Division office in Albuquerque, N.M., found that Castillo employees did not receive overtime compensation for all hours worked over 40 in a workweek. In addition, the company failed to maintain the required time and payroll records.
Castillo Ready Mix, which provides pre cast cement related products, has agreed to future compliance with all provisions of the FLSA.
The FLSA requires that covered employees be paid at least the federal minimum wage of $7.25 for all hours worked, plus time and one-half their regular rates of pay, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Employers must also maintain accurate time and payroll records
