Midland, Texas-based Dawson Geophysical Co. pays more than $100,000 in overtime back wages following US Labor Department investigation


MIDLAND, Texas -- Dawson Geophysical Co. in Midland has paid $100,356 in overtime back wages after an investigation by the U.S. Department of Labor found that 24 current and former field clerks were not properly paid as required by the Fair Labor Standards Act (FLSA).

“Employees are entitled to receive all the wages they have rightfully earned,” said Cynthia Watson, the Wage and Hour Division’s regional administrator in Dallas, Texas. “In this case, the position these employees held did not meet the duties requirements for exemption.”

The investigation by the department’s Wage and Hour Division in Albuquerque, N.M., found that the oil and gas exploration company misclassified workers as being executive or administrative staff, when in fact they were entitled to receive overtime wages for hours worked over 40 in a week.

The FLSA requires that covered employees be paid at least the federal minimum wage of $7.25 for all hours worked, plus time and one-half their regular rates of pay, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Employers must also maintain accurate time and payroll records.
