US Labor Department recovers more than $560,000 in back wages for employees of Stone and Webster Construction in Pueblo, Colo.
DENVER -- The U.S. Department of Labor’s Wage and Hour Division has recovered $562,901 in back wages for 1,411 construction workers employed by Stone and Webster Construction Inc. in Pueblo, Colo., following an investigation that disclosed violations of the Fair Labor Standards Act’s (FLSA) overtime provisions
The Wage and Hour Division’s Denver District Office found that Stone and Webster, a division of the Shaw Group—a “Fortune 500” company, did not include retention bonuses and daily bonuses when computing overtime pay for employees.
“When computing overtime pay, employers are required to include the value of some other types of compensation, such as retention and daily bonuses, in the regular rate for overtime purposes,” said Cynthia Watson, the Wage and Hour Division’s regional administrator in Dallas.
The FLSA requires covered, nonexempt employees to be paid at least the federal minimum wage of $7.25 per hour for all hours worked, plus time and one-half their regular rates of pay, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Under the law, employers must also maintain accurate time and payroll records.
